1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS g GEORGE ERNEST HAGEN g AND ORDER OF PROBATION 7 On or about July 26, 2002, the Teacher Standards and Practices Commission 8 (Commission) received an application for a Substitute Teaching License from George Ernest - 9 Hagen (Hagen). Mr. Hagen reported criminal convictions on the character question section of 10 Application for Educator License Form C-1. 11 After review of the facts in this matter, Mr. Hagen and the Executive Director agree that 12 their respective interests, together with the public interests, are best served by a stipulation to 13 certain facts and the issuance of Iicensure subject to a three (3) year probation. 14 This Order sets forth the facts upon which the parties have agreed and the sanction to . be imposed. Mr. Hagen stipulates that there are sufficient facts contained in the Commission's 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Hagen waives the right to a hearing to contest the findings of 18 fact, conclusion of law and order set forth below. Mr. Hagen understands that the Commission 19 will impose a three (3) year probation with specific conditions. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Hagen nor the 22 Commission are bound by these Stipulations and Mr. Hagen retains all rights to a hearing on 23 the allegations. 24 STIPULATION 0F FACTS 25 1. On December 11, 1989, Mr. Hagen was convicted of Driving While Suspended (a 2 misdemeanor) in District Court of the State of Oregon for Polk County. 3 3. On March 23, 1990, Mr. Hagen was granted Diversion for Driving Under the Influence 4 of lntoxicants (DUII) in District Court of the State of Oregon for Polk County. 5 4. On October 25, 1991, Mr. Hagen was convicted of Driving Under the Influence of 6 lntoxicants (DUII) in District Court of the State of Oregon for Polk County. 7 5. On January 6, 1992, Mr. Hagen was convicted of Driving While Suspended/Revoked 8 (a felony) in Circuit Court of the State of Oregon for Polk County. _ 9 6. On February 3, 1993, Mr. Hagen was convicted of Driving While Suspended/Revoked 1O (a felony) in Circuit Court of the State of Oregon for Polk County. He was granted misdemeanor 1 1 treatment at sentencing. 12 7. Mr. Hagen accepts responsibility for his behavior and acknowledges his behavior was inappropriate. Mr. Hagen’s driving privileges were fully reinstated on December 26, 1996. é 8. Conviction of a crime may be used as evidence to establish an 26 applicant's lack of fitness to serve as an educator pursuant to ORS 342.143. ' /// Page 2 STIPULATION OF FACTS AND ORDER OF PROBATION - HAGEN ‘ ORDER 2 The Commission adopts the above Stipulation of Facts and authorizes the issuance of a 3 Substitute Teaching License to George Ernest Hagen subject to all standard terms and 4 conditions. 5 Furthermore, the Commission imposes a three (3) year probation to commence on the . 6 date of issuance, subject to the following special terms: 7 1. Mr. Hagen shall conduct him self as a law-abiding citizen; 8 2. Mr. Hagen shall report in writing within ten days to the Executive Director of the 9 Commission any arrest or citation for any felony, misdemeanor, or major traffic 10 violation; and 11 3. Mr. Hagen shall comply with the Standards for Competent and Ethical Performance 12 of Oregon Educators under OAR Chapter 584, Division 020.
