1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON i In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 BRUCE EDWARD JORDAN ) LICENSE REVOCATION 7 8 On October 9, 2008, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Bruce E. Jordan (Jordan) in which the Commission 10 charged him with misconduct under ORS 342.175. The Notice was sent via U.S. First Class 11 Mail and U.S. Certified Mail Receipt 7006 1140 0002 8581 2164 to the address on file with the 12 Commission with a copy to his attorney. The Notice of Opportunity of Hearing, dated July 22, 13 2008, and signed by Victoria Chamberlain, Executive Director, stated: 14 "You, Bruce Jordan, are entitled to a hearing on the proposed action of the 15 Commission. If you want a hearing, you must file a written request for a hearing 16 with the Commission within 21 days of the date of this notice. Attached to this 17 notice is a copy of the procedures, right of representation and other rights of 18 parties relating to the conduct of a hearing as required under ORS 183.413(2)." 2(9) On August 13, 2008, the Commission received a letter from Jordan’s attorney 21 stating that Jordan did not intend to request a hearing. The Commission, therefore, finds 22 Mr. Jordan to be in default and enters the following findings of fact, conclusions of law 23 and order, based on the files and records of the Commission concerning this matter. 24 FINDINGS 0F FACT 25 1. During the 2006-2007 school year, while working for the Grants Pass School District, 26 Jordan began frequently calling, exchanging text messages and visiting with a female student, 1 27 during a time of personal hardship for the student. Many of the phone calls and text messages 28 were exchanged very early in the morning or late in the evening. This conduct constitutes gross 29 neglect of duty in violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020- ‘ 30 0035(1)(c)(A) and (C) because Jordan demonstrated professionally inappropriate interest in a 31 student's personal life and failed to report to his supervisors that the student was becoming 32 romantically attached to him. This conduct also constitutes gross neglect of duty in violation of ’ PAGE 1 — DEFAULT ORDER OF LICENSE REVOCATION — BRUCE JORDAN 1 OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(5) because Jordan failed to use 2 professional judgment. 3 2. During the 2006-2007 school year, while working for the Grants Pass School District, 4 Jordan gave gifts such as flowers and sent personal messages to a female student. Many of 5 the emails that Jordan sent to the female student were signed “X’s and 0's” (hugs and kisses) 6 and cautioned against sending messages with romantic overtones to particular addresses or at 7 particular times due to security and privacy concerns. This conduct constitutes gross neglect of 8 duty in violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(1)(c)(B) 9 because Jordan exchanged romantic and overly personal notes with a female student. This 10 conduct also constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(n) as it 11 incorporates OAR 584-020-0010(5) because Jordan tailed to use professional judgment. 12 3. During the 2006-2007 school year, while working for the Grants Pass School District, 13 Jordan was approached by the female student's mother with concerns about the late night 14 phone calls and text messages exchanged between Jordan and her daughter. Jordan assured 15 the female student's mother that he was only attempting to help the student through her 16 personal hardship. This conduct constitutes gross neglect of duty in violation of OAR 584-020- 17 0040(4)(c) because Jordan knowingly misrepresented his interaction with the female student as 18 being part of his professional duties. 19 4. During the 2006-2007 school year, while working for the Grants Pass School District, 20 Jordan began a relationship with a female student that included hugging and kissing. Some of 21 this conduct occurred in his classroom. On July 12, 2007, Jordan admitted during a police 22 interview to French kissing the female student, hugging her and allowing her to sit on his lap. 23 This conduct constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(f) because it 24 constitutes sexual conduct with a student as that term is defined in OAR 584-020-0005; and 25 OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(1)(c)(D) because Jordan failed 26 to honor appropriate adult boundaries with a student.
