BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 RALPH FREDERICK KING ) LICENSE REVOCATION 7 8 On May 13, 2004, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Ralph Frederick King (King) in which the 10 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S. I 1 First Class Mail and U.S. Certified Mail Receipt 7003 2260 0000 8804 5931 to the address 12 Mr. King provided to the Commission on his application for licensure. The certified mail receipt l3 was signed and dated on May 24, 2004. The Notice of Opportunity of Hearing, dated May 13, l4 2004, and signed by Victoria Chamberlain, Executive Director, stated: 15 "You, Ralph Frederick King, are entitled to a hearing on the proposed action of 16 the Commission. If you want a hearing, you must file a written request for a hearing with the Commission within 21 days of the date of this notice. Attached to this notice is a copy of the procedures, right of representation and other rights i 9 of parties relating to the conduct of a hearing as required under ORS 20 183.413(2).” 21 22 Mr. King did not request a hearing. The Commission, therefore, finds 23 Mr. King to be in default and enters the following findings of fact, conclusions of law and 24 order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. King holds a Standard Teaching License with endorsements in Office Systems, 27 Basic Social Studies, Standard General Business Education and Accounting/Financial Systems, 28 issued December 10, 2002, valid until November 18, 2007. 29 2. Mr. King was employed as a teacher for Gilchrist High School, Klamath County 30 School District. He began his employment with the District in August of 1983. Mr. King 31 resigned his employment with the District on November 7, 2003. . PAGE 1 — DEFAULT ORDER OF LICENSE REVOCATION - KlNG .1 3. On March 7, 2003, the Commission issued Mr. King a Public Reprimand for behavior 2 that created an intimidating, hostile or offensive educational environment. Additionally, Mr. King 3 was reprimanded for destruction of public property. ' 4 4. In June of 2003, at Gilchrist Junior/Senior High School, Klamath County School 5 District, Mr. King made insulting and humiliating remarks to a female student when she failed to ‘ ‘ o answer a review question he asked. On December 17, 2001, Mr. King was reprimanded by his 7 supervisor for using inappropriate language when addressing students. 8 9 CONCLUSIONS OF LAW 10 The above conduct constitutes Gross Neglect of Duty in violation of OAR 584-020- 11 0040(4)(n). This conduct constitutes Gross Neglect of Duty. The Commissions authority to 12 impose discipline in this matter is based upon ORS 342.175.
