g On November 14, 2012, the Teacher Standards and Practices Commission
8 (Commission) received a report from the Fern Ridge School District reporting potential
9 professional misconduct on the part of licensed educator, Michael John English
1 O (English).
1 1 After review of the matters alleged, English and the Commission agree that their
1 2 respective interests, together with the public interest, are best served by a stipulation to
13 certain facts and the imposition of a public reprimand.
14 By signing below, English acknowledges, understands, stipulates, and agrees to
15 the following: (i) he has been fully advised of his rights to notice and a hearing to contest l
16 the findings of fact, conclusions of law, and order set forth below, and fully and finally
17 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
18 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation
19 and Final Order is a public document and disclosed to the public upon request by the
20 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to
21 approval and adoption by the Commission. If the Commission does not approve and
22 adopt this Stipulation and Final Order, then neither English nor the Commission are
23 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and
24 understands it completely; (v) he voluntarily, without any force or duress, enters into
25 this Stipulation and Final Order and consents to issuance and entry of the Stipulated
26 Final Order below; (vi) he states that no promise or representation has been made to
27 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an
28 attorney regarding this Stipulation and Final Order and has been fully advised with
29 regard to his rights thereto, or waives any and all rights to consult with an attorney prior
30 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated
31 Final Order below.
32 STIPULATION OF FACTS
33 1. Michael John English has been licensed by the Commission since September 3, 1976.
34 English’s Standard Teaching License, with endorsements in Standard Exceptional
35 Learner I (018) and Standard Social Studies (020), is valid from September 17, 2013

1 through September 16, 2018. During all relevant times, English was employed by the
2 Fern Ridge School District.
3 2. On November 14, 2012, the Commission received a report from the Fern Ridge
4 School District alleging English violated professional standards and practices.
5 The resulting District, and Commission investigations determined:
6 a. On or about October 15, 2012, English engaged in a conversation with a school
7 employee who advised English that a student would be late for class. English
8 responded in essence “You might as well shoot him before he gets here”. The
‘ 9 employee asked English, “What?” and English repeated his statement. This
‘ 1O conversation occurred within earshot of students. English asserts he intended
1 1 his statements to be humorous. English used a conversational and joking tone,
12 and his physical demeanor was non-threatening. There is no evidence of any
13 actual threat of harm.
14 b. On or about October 24, 2012, English was asked by another employee if he
15 was okay with supervising students from another classroom while they worked
16 on computers. In essence English responded, “Yeah, they’re okay. They know
17 if they are not quiet I ’ll take them out back and shoot them.” Students were
18 working quietly and the statement was loud enough so most or all students
19 heard the comments. English asserts he intended his statement to be
20 humorous. English used a conversational and joking tone, and his physical
21 demeanor was non-threatening. There is no evidence of any actual threat of ,
22 harm. i

24 English’s comments caused concern amongst the employees involved and
25 reported English’s statements to administrators. English was issued a written
26 warning by the district 0n November 9, 2012.

37 CONCLUSION OF LAW
38 Michael John English made inappropriate comments to other educators in the
39 presence of students. This conduct constitutes gross neglect of duty in violation of ORS

1 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-oo1o(5) (Use
2 professional judgment), and OAR 584-020-oo3o(2)(b) (Skill in communicating with
3 administrators, students, staff, parents, and other patrons).
4 The Commission's authority to impose discipline in this matter is based upon
y 5 ORS 342.175.

7 Based on the foregoing, the Commission hereby orders as follows:
8 1. The Commission adopts and incorporates herein the above findings of fact and
9 conclusions of law, and based thereon, imposes a Public Reprimand on
