9 On August 26, 2003, the Teacher Standards and Practices Commission (Commission)
10 issued a Notice of Opportunity for Hearing to Harry Newton Chandler (Chandler) in which the
11 Commission charged him with conviction of a crime listed in ORS 342.143(3). The Notice was
12 sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7002 2410 0001 9754 7191 to the
13 address obtained by the Commission. The certified mail receipt was signed by Harry Chandler
14 dated August 28, 2003. The Notice of Opportunity of Hearing, dated August 26, 2003, and
15 signed by Victoria Chamberlain, Executive Director, stated: _
16 "You, Harry Newton Chandler, are entitled to a hearing on the proposed action of
17 the Commission. If you want a hearing, you must file a written request for a
18 hearing with the Commission within 21 days of the date of this notice. Attached
q to this notice is a copy of the procedures, right of representation and other rights
of parties relating to the conduct of a hearing as required under ORS
21 183.413(2)."

23 Mr. Chandler did not request a hearing. The Commission, therefore, finds
24 Mr. Chandler to be in default and enters the following findings of fact, conclusions of law
25 and order, based on the files and records of the Commission concerning this matter.
26 FINDINGS OF FACT
27 11 Mr. Chandler holds a Standard Teaching License with Basic Language Arts and
28 Standard Handicapped Learner l Endorsements, issued December 22, 1997, valid until 1
29 November 5, 2003. i

30 2. Mr. Chandler was employed by the McMinnville School District as a Language Arts
31 Teacher from August 25, 1975, to June 12, 1998.

1 3. On June 12, 2002, Harry Newton Chandler was convicted of Encouraging Child Sex
'2 Abuse, ORS 163.684 in the Circuit Court of the State of Oregon for Yamhill County.
3 CONCLUSIONS OF LAW
4 The crime of Encouraging Child Sex Abuse is listed in ORS 342.143(3). The
5 Commission is required to revoke the Oregon Standard Teaching License issued to Harry
6 Newton Chandler pursuant to ORS 342.175(2). _
7 ORDER
8 The Commission hereby revokes the Oregon Standard Teaching License issued to
9 Harry Newton Chandler. $
10 IT IS SO ORDERED this Q day of October 2003.
