WALKER ) AND PROBATION s On or about May 1, 2003, the Teacher Standards and Practices Commission 8 (Commission) received a complete application for renewal of a Standard Teaching 9 License from Robert H. Walker (Walker). Mr. Walker responded affirmatively to a 1O character question regarding a criminal conviction for Driving Under the Influence of 11 lntoxicants (DUII) on March 10, 2003, in Multnomah County. 12 After review of the matters alleged, Mr. Walker and the Commission agree that 13 their respective interests, together with the public interest, are best served by a 14 stipulation to certain facts, the imposition of a Public Reprimand and a four (4) year ‘ probation. This Order sets forth the facts upon which the parties have agreed and the 16 sanction to be imposed. Mr. Walker stipulates that there are sufficient facts contained in 17 the Commission’s files and records to support the findings of fact and conclusions of law 18 set forth below. In entering into this stipulation, Mr. Walker waives the right to a hearing 19 to contest the findings of fact, conclusion of law and order set forth below. Mr. Walker 20 understands that the probation will be subject to specific conditions. 21 STIPULATION OF FACTS 22 1. On June 22, 1998, the Commission issued a Standard Teaching License to 23 Robert Walker. That license expired on March 13, 2003. On May 1, 2003, Mr. Walker 24 submitted a complete application for renewal of a Standard Teaching License. O Page 1-STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION —WALKER, ROBERT 1 2. Mr. Walker is employed by Portland Public Schools. He began his ' employment with the District in January of 1987. 3 3. In May of 1973, Mr. Walker was arrested for DUII in Oakland, California. Mr. 4 Walker was not prosecuted the charge was not filed in court. 5 4. On November 15, 1983, Mr. Walker was arrested for DUII in Multnomah 6 County. Mr. Walker successfully completed a diversion program and the charge was 7 dismissed. 8 5. On December 14, 1996, Mr. Walker was arrested for DUII in Multnomah 9 County. Mr. Walker successfully completed a diversion program and the charge was 1O dismissed on March 26, 1998. 11 6. On September 6, 2002, Mr. Walker was arrested for DUII in Portland, Oregon. 12 On March 10, 2003, Mr. Walker was convicted of DUII in the Circuit Court for the State ‘ of Oregon for Multnomah County. 14 7. On March 20, 2003, Mr. Walker successfully completed an alcohol addiction 15 program at Kaiser Pen'nanente Northwest, Department of Addiction Medicine. 16 8. Mr. Walker recognizes that he has an alcohol dependency problem. 17 Robert Walker enters into this Stipulation of Facts with the knowledge that the 18 Teacher Standards and Practices Commission shall place him on probation for a period 19 of four (4) years. This Stipulation is contingent upon approval and adoption of the Order 2O by the full Commission. Walk Date 7 flew-a 8 Victoria Chanb- in, Executi e Director Date 9 Teacher Standards and Practices Commission 10 CONCLUSIONS OF LAW 11 By Driving Under the Influence of lntoxicants in May of 1973, November 15, 12 1983, December 14, 1996 and September 6, 2002, Robert Walker engaged in acts 13 constituting criminal conduct in violation of OAR 584-020-0040(5)(e). On March 10, ‘ 2003, Robert Walker was convicted of DUII, ORS 813.010 a misdemeanor crime, in 15 violation of OAR 584-020-0040(5)(c). This misconduct constitutes Gross Unfitness. 16 The Commission's authority to impose discipline in this matter is based upon ORS 17 342.175. 18 /// 19 /// 20 /// O Page 3-STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION —WALKER, ROBERT 1 . ORDER 3 The Commission adopts the above stipulation of facts and imposes a Public 4 Reprimand upon Mr. Walker. This Stipulation of Facts, Order and Probation constitute 5 the Reprimand. 6 Furthermore, the Commission imposes a four (4) year probation upon Mr. Walker 7 subject to the following terms and conditions: 8 1. Mr. Walker shall provide the Executive Director with a copy of the treatment 9 plan and at his own initiative and expense, continue to obtain treatment for his alcohol 1O dependency as recommended by his alcohol treatment provider; 11 2. During the period of this probation, Mr. Walker shall comply with the terms of 12 the treatment and aftercare plans. Mr. Walker shall abstain from the consumption of ‘ alcohol; 14 3. During the period of his probation, Mr. Walker shall submit to the Executive 15 Director of the Commission reports of his compliance with the treatment plan. Mr. 16 Walker shall provide these reports every six (6) months during his probation, on or 17 before April 10, 2004; October 10, 2004; April 10, 2005; October 10, 2005; April 10, 18 2006; October 10, 2006; April 10, 2007; and October 10, 2007; 19 4. Mr. Walker shall report in writing within ten days to the Executive Director of ‘ 20 the Commission any arrest or citation for any felony, misdemeanor, major traffic 21 violation or violation of criminal probation; and 22 5. Mr. Walker shall comply with all Standards for Competent and Ethical 23 Performance under Oregon Administrative Rules Chapter 584, Division 020. O Page 4-STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - WALKER, ROBERT 1 If Mr. Walker does not comply with all terms and conditions of this probation, ‘ based on the reports of his treatment provider or as otherwise determined by the 3 Executive Director, he shall be in violation of this probation.
