The notice was sent via U.S. First Class 12 Mail and U.S. Certified Mail Receipt #Z 204 897 189. Mr. Cline responded on June 6, 2000, stating he 13 Will not be requesting a hearing on this matter. 14 15 16 FINDINGS OF FACT 17 18 l. On or about August 3, 1999, Cline violated OAR 584-020-0040(4)(f) when he placed his hand on 19 the leg of EJ a female high school student in the Beaverton School District and repeatedly told 20 her he wanted t0 hug and kiss her. Cline was performing a driver license examination with EJ at 21 the time of the incident. 22 23 2. On or about February 23, 2000, Cline violated OAR 584-020-0040(5)(c) when he was convicted 24 of Harassment in Beaverton Municipal Court as a result of his “offensive physical” contact with 25 the female student, EJ. . 26 l. 27 28 ULTIMATE FINDINGS OF FACT 29 30 Robert Cline placed his hand on the leg of EJ and repeatedly told her he wanted to hug and lciss her While 31 he was performing a driver license examination of EJ. 32 33 $4 CONCLUSIONS OF LAW 35 36 Mr. Cline’s sexual contact with a student constitutes gross neglect of duty in violation of OAR 584-020- 37 0040(4)(f) and his conviction constitutes gross unfitness in violation of OAR 584-020-0040(5)(c). 38 39 4O OPINION 41 42 Mr. Cline’s contact with EJ was the result of his position as a driver license examiner.
