OF THE STATE OF OREGON 3 In the Matter of the ) i STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION 5 NORMAN RONALD NORQUIST ) AND PROBATION S ) 8 On or about June 21, 2002, the Teacher Standards and Practices Commission 9 (Commission) received a report from Michael Call, Superintendent, Estacada School 1O District, alleging that Norman Ronald Norquist (Norquist) used his school computer to 11 access sexually explicit material on the Internet. 12 Mr. Norquist fully cooperated with the Commission‘s investigation. After review 13 of the matters alleged, Mr. Norquist and the Commission agree that their respective 14 interests, together with the public interest, are best served by a stipulation to certain 1 facts and the imposition of a ninety (90) day suspension, followed by a period of 16 probation of two (2) years. 17 This Order sets forth the facts upon which the parties have agreed and the 18 sanction to be imposed. In entering into this stipulation, Mr. Norquist waives the right to 19 a hearing to contest the finding of fact, conclusion of law and order set forth below. Mr. 20 Norquist understands that the probation will be subject to specific conditions. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Norquist nor the 23 Commission are bound by these Stipulations and Mr. Norquist retains all rights to a 24 hearing on the allegations. Mr. Norquist holds a Basic Teaching License with a Basic Elementary 3 Endorsement issued July 18, 2000, valid through March 12, 2004, with Endorsements in 4 Basic Music and Basic Elementary. 5 2. Mr. Norquist was employed by Estacada School District as a Teacher at 6 Eagle Creek Elementary School beginning October 12, 1999. He resigned his 7 employment with the District on August 21, 2002. 8 3. Mr. Norquist was convicted of Criminal Trespass II for civil disobedience in the 9 District Court of the State of Oregon for Washington County on March 7, 1989, 1O August 16, 1989, October 10, 1989, and December 18, 1989. 11 4. A District-owned computer with Internet access was present in Mr. Norquists 12 classroom for his usein connection with his assigned responsibilities. The District has a . clearly defined, acceptable use policy. The District's policy prohibits the use or 14 attempted use of equipment for Internet access of sexually explicit materials. 15 5. Mr. Norquist used his classroom computer on multiple occasions to access 16 sexually explicit materials through the Districts Internet connection in violation of District 17 policy regarding Internet use during student contact hours and non-student contact 18 hours. 19 / 6. Mr. Norquist was fully aware that accessing such materials at the workplace 5 with a District owned computer was inappropriate and against District policy. 6 CONCLUSION OF LAW 7 Norman Ronald Norquist‘s use of a district computer constitutes gross neglect of 8 duty in violation of OAR 584-020-0040(4)(q). The Commission’s authority to impose 9 discipline in this matter is based upon ORS 342.175. 10 ORDER 11 Norman Ronald Norquist‘s Basic Teaching License is suspended for a period of 12 ninety (90) days beginning on October 11, 2002. At the end of this suspension period, . Mr. Norquist‘s Basic Teaching License will be reinstated upon: 14 1. Submission of a complete application and fees pursuant to OAR 584-050- 15 0015(3); 16 2. Submission of documentation that he has undergone an evaluation by a 17. psychotherapist or medical professional acceptable to the Commission, and the 18 evaluator submits a written report to the Commission attesting (a) Mr. Norquist is fit to 19 work with children and teenagers, and (b) there is a high probability he will not use 20 school district equipment to access sexually explicit materials or engage in similar 21 inappropriate behavior. Any costs associated with the assessment or treatment will be 22 the responsibility of Mr. Norquist. 23 Upon the reinstatement of his teaching license, Mr. Norquist shall be placed on .- probation by the Commission for a period of two (2) years subject to the following 25 conditions: Page 3 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - NORQUIST 1 1. Mr. Norquist Shall substantially comply with any treatment or counseling as ‘ recommended by the individual who completed the evaluation described above. Mr. 3 Norquist shall authorize and sign any consent forms as necessary for the treatment 4 provider or counselor to furnish records to or discuss Mr. Norquist’s treatment with the 5 Commission. 6 2. Mr. Norquist shall comply with all Standards for Competent and Ethical 7 Performance under Chapter OAR 584, Division O20. 8 3.
