BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF o LANCE MICHAEL GILMORE ) LICENSE REVOCATION 7 8 On January 21, 2005, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Lance Michael Gilmore (Gilmore) in which the 10 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S. ll First Class Mail and U.S. Certified Mail Receipt 7003 2260 0000 8922 9200 t0 the address that 12 the Commission obtained from the U.S. Post Office. On February 18, 2005, the U.S. Certified I3 Mail was returned to the Commission as “unclaimed”. The Notice of Opportunity of Hearing, I4 dated January 21, 2005, and signed by Victoria Chamberlain, Executive Director, stated: 15 "You, Lance Michael Gilmore, are entitled to a hearing on the proposed action of I6 the Commission. It you want a hearing, you must file a written request tor a 1 hearing with the Commission within 21 days of the date of this notice. Attached to this notice is a copy of the procedures, right of representation and other rights 9 of parties relating to the conduct of a hearing as required under ORS 20 183.413(2).“ 21 22 Mr. Gilmore did not request a hearing. The Commission, therefore, finds 23 Mr. Gilmore to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the tiles and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. Gilmore holds a Basic Teaching License with endorsements in Basic Elementary 27 and Basic Mathematics, issued April 8, 2004, valid until April 1, 2007. 28 2. Mr. Gilmore was employed as a substitute teacher and coach tor North Bend School 29 District. During the evenings of May 14 and 15, 2004, Mr. Gilmore furnished alcohol to male '2 North Bend High School students while coaching the boy’s golf team in Sunriver, Oregon. 3 4. During the evenings of May 14 and 15, 2004, Mr. Gilmore engaged students in poker 4 games and won approximately $30 from North Bend High School students while coaching the 5 boy's golf team in Sunriver, Oregon. o 5. On September 24, 2004, Mr. Gilmore was convicted for Furnishing Liquor to a Minor 7 In the Circuit Court of the State of Oregon for Deschutes County. 8 CONCLUSIONS OF LAW 9 Items 3 and 4 above constitute Gross Neglect of Duty in violation of OAR 584-020- 10 0040(4) and 584-020-0040(4)(o), as it incorporates OAR 584-020-0035(1)(c). Mr. Gilmore’s Il criminal conviction for Furnishing Liquor to a Minor constitutes Gross Unfitness In violation of 12 OAR 584-020-0040(5)(c). The Commission’s authority to impose discipline in this matter is 3 based upon ORS 342.175.
