Mr. Reed requested a hearing. 10 After a review of the matters alleged, the Commission and Mr. Reed have agreed that 1 1 their respective interests, together with the public interest,‘ are best served by a stipulation to a certain facts and the imposition of a public reprimand and a period probation. In entering into this stipulation, Mr. Reed waives his right to a hearing and understands 14 that the Commission will impose the discipline set forth in this order. This stipulation and 15 proposed order are contingent on approval by the full Commission. Ifthe Commission does not 16 approve this stipulation and order, it is understood that any waiver of rights by Mr. Reed is 17 therefore revoked. It is further understood that the statements contained in this stipulation may 18 not be used by either the Commission or Mr. Reed for any reason if the Commission fails to 19 approve the stipulation and proposed order. 20 Mr. Reed agrees and stipulates to the finding that he licked the blood from a wound on ( 21 student KE. Mr. Reed holds an Oregon Basic Teaching License, valid from April 28, 2004, 10 through July 5, 2007, with endorsements in Basic Physics, Standard Chemistry and Standard 11 Social Studies. He has held an Oregon Teaching License since September 1995. 62 2. Mr. Reed was employed by the Central Linn School District during the 2003-4 school year as the dean of students and as a coach. i 14 3. On about May 5, 2004, while serving as a middle school track coach, Mr. Reed 15 licked the blood from a wound on the knee of LE, a female middle school student. 16 4. During the 2003 football season, Mr. Reed licked blood from the arm of KL, a 17 male student in the school locker room before a football practice. 18 5i During the 2003 football season, Mr. Reed licked blood from the hand ofCCH, a 19 male high school student. 20 6. Scott Lloyd Reed’s action in licking the blood of students constitutes gross neglect of 3 duty in violation of OAR 584-020-0040(4)(n) as that rule incorporates OAR 584-020-0010(5) 4 and 584-020-0025(2)(e). 5 ORDER 6 The Commission imposes a public reprimand upon Scott Lloyd Reed, and this order shall 7 serve as the public reprimand. 8 Mr. Reed shall be placed on probation with the Commission for a period of two years 9 from the date of this order. Conditions of probation shall include the following: 10 l. Within the next 60 days, Mr. Reed shall attend a class concerning safety and ll avoiding risk of exposure to blood-borne pathogens‘ Mr. Reed shall furnish to the Commission l2 written verification of his attendance. ‘ 2. Mr. Reed shall not lick blood on the person of any student or co-worker. l4 3. Mr. Reed shall comply with all Standards of Competent and Ethical Performance 15 of Educators under OAR 584 Division 020. l6 Failure to comply with any condition of probation shall be a basis in itself for discipline, l7 up to and including revocation of Mr. Reed’s teaching license, subject to Mr. Reed’s right to a 18 hearing on the issue of whether he- violated probation. .
