In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE REVOCATION AND 6 CHRISTOPHER FREDERICK SMITH ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE s 9 On April 13, 2007, the Teacher Standards and Practices Commission (Commission) issued a 10 Notice of Opportunity for Hearing to Christopher Frederick Smith (Smith) in which the Commission 11 charged him with conviction of a crime listed in ORS 342.143(3). The Notice was sent via U.S. First 12 Class Mail and U.S. Certified Mail Receipt 7005 1160 0001 0494 2888 to the address Mr. Smith 13 provided to the Commission. The certified mail receipt was signed by Alice Smith and returned to the 14 Commission on April 19, 2007. The Notice of Opportunity of Hearing, dated April 13, 2007, and 15 signed by Victoria Chamberlain, Executive Director, stated: 16 "You, Christopher Frederick Smith, are entitled to a hearing on the proposed action of 17 the Commission. If you want a hearing, you must file a written request for a hearing 18 with the Commission within 21 days of the date of this notice. Attached to this notice is . a copy of the procedures, right of representation and other rights of parties relating to the conduct of a hearing as required under ORS 183.413(2).” 21 22 Mr. Smith did not request a hearing. The Commission, therefore, finds Mr. Smith to be 23 in default and enters the following findings of fact, conclusions of law and order, based on the 24 files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. Smith has been licensed by the Commission since July 18, 1983. The Commission 27 issued Mr. Smith a Standard Teaching License on September 17, 2003, valid until August 13, 2008, 28 with Basic Basic Mathematics, Standard Health Education and Standard Physical Education 29 Endorsements. 30 2. Mr. Smith began employment with Redmond School District in August of 1991. 31 3. On March 28, 2007, Mr. Smith was convicted for Disseminate Obscene Material, ORS 32 167.087 in the Circuit Court of the State of Oregon for Deschutes County. ' /// 1 — DEFAULT ORDER OF LICENSE REVOCATION AND REVOCATION OF RIGHT TO APPLY — SMITH 1 CONCLUSIONS OF LAW ’ Mr. Smith's conviction for Disseminate Obscene Material, ORS 167.087 is listed in ORS 3 342.143(3). The Commission is required to revoke the Standard Teaching License issued to 4 Mr. Smith and revoke his right to apply tor a license pursuant to ORS 342.175(2).
