1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION .2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Licensure of ) DEFAULT ORDER DENYING 5 BENEDICT CHARLES OCHS ) RENEWAL OF LICENSURE g ) 8 On March 21, 2003, the Teacher Standards and Practices Commission issued a 9 Notice of Opportunity for Hearing to Benedict Charles Ochs, in which the Commission 10 proposed to deny renewal of a license under ORS 342.135 and its administrative rules 11 implementing that legal authority OAR 584-050-0007. The Notice was sent via U.S. First 12 Class Mail and U.S. Certified Mail Receipt #7001 0320 0005 0740 4751 to the address Mr. 13 Ochs provided to the Commission. The certified mail receipt was signed by Adrienne Ochs 14 and returned to the Commission on March 31, 2003. Benedict Ochs did not request a 15 hearing. ‘\ The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive 17 Director, stated: 18 If a request for hearing is not received within this 21-day period, your right to 19 hearing shall be considered waived unless your failure to request a hearing was 20 beyond your reasonable control. If you do not request a hearing or if you fail to 21 appear at a hearing, the Commission will uphold the denial of your application for 22 reinstatement of an Oregon teaching license. ii Based on the foregoing, the Commission finds Benedict Charles Ochs in default and 25 such default is hereby entered. Based on the records and files of the Commission, the 26 Commission enters the following findings of fact, conclusions of law and order. 27 FINDINGS OF FACT 28 1. Mr. Ochs held a Standard Teaching License with endorsements in Standards 29 Technology Education and Mechanical Technology valid October 13, 1997, through October 30, 30 2002. On or about October 22, 2002, TSPC received an Application for Educator License Q Form C-1 signed by Benedict Ochs along with additional documentation to apply for renewal of 3 his Standard Teaching License.
