6 On June 17, 2005, the Teacher Standards and Practices Commission (Commission)
7 received a report from Clementina Salinas, Superintendent, Oregon Trail School District alleging
8 that during the 2004-2005 school year, Douglas Dewayne Castle (Castle), videotaped female
9 students inappropriately.
10 Mr. Castle fully cooperated with the Commission’s investigation in this matter. After
11 review of the matters alleged, Mr. Castle and the Commission agree that their respective
12 interests, together with the public interest, are best served by a stipulation to certain facts and a
13 public reprimand.
14 This document sets forth the facts upon which the parties have agreed and the
‘ stipulated sanction to be imposed. Mr. Castle stipulates that there is sufficient evidence in the
16 Commission's ﬁles and records to support the findings of fact, conclusions of law, and order set
17 forth below.
18 By signing below, Mr. Castle acknowledges, understands, stipulates, and agrees to the
19 following: (i) he has been fully advised of his rights to notice and a hearing to contest the
20 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
21 such rights and any rights to appeal or othenrvise challenge this Stipulation of Facts and Final
22 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public
23 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
24 Final Order is contingent upon and subject to approval and adoption by the Commission. If the
25 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr.
26 Castle nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation
‘ and Final Order, and understands it completely; (v) he voluntarily, without any force or duress,
28 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated

1 Final Order below; (vi) he states that no promises or representation has been made to induce
' him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney
3 regarding this Stipulation and Final Order and has been fully advised with regard to his rights
4 thereto, or waives any and all rights to consult with an attorney prior to entering into this
5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.
6 STIPULATION 0F FACTS
7 1. Mr. Castle has been licensed by the Commission since July 1, 1975. Mr. Castle most
8 recently held a Standard Teaching License issued June 29, 2000. Said license expired on
9 June 10, 2005. Mr. Castle retired effective June 15, 2005i
10 2. Mr. Castle began employment for Oregon Trail School District in 1997, but previously
11 was employed in the Cottrell Elementary School District, one of the Districts that merged into
12 the Oregon Trail School District in 1997. In total, Mr. Castle worked for the District and one of
13 the predecessor Districts from 1979 to 2005.
.1 3. During the 2004-2005 school year, at Firwood Elementary School, while videotaping
15 student music performances for educational purposes, Mr. Castle periodically inappropriately
16 focused the video camera such that he videotaped the buttocks and legs of female students,
17 primarily 4m and 5"‘ graders. Mr. Castle only videotaped female students. A few students
18 reported that Mr. Castle made them feel uncomfortable.
19 4. Mr. Castle has accepted responsibility for and regrets his actions. On his own
20 initiative, Mr. Castle has entered into and has continued with counseling to address his
21 inappropriate behavior.

1 CONCLUSIONS OF LAW
‘ During the 2004-2005 school year at Firwood Elementary School, Oregon Trail School
3 District, Douglas Dewayne Castle violated OAR 584-020-0040(4)(n) as referenced in OAR 584-
4 020-0010(5) when he failed to demonstrate a commitment to use professional judgment by ;
5 videotaping female students in his classroom below the waist. This misconduct constitutes ‘
6 Gross Neglect of Duty. The Commission has the authority to impose discipline in this matter
7 under ORS 342.120 through 342.430 and OAR Chapter 584.
8 ORDER
9 The Commission hereby adopts and incorporates herein the above findings ot fact,
10 conclusions of law and imposes a Public Reprimand upon the licensure of Douglas Dewayne
11 Castle subject to the condition that he seek counseling by a licensed approved counselor, follow
12 recommendations made by the counselor and agree to not seek employment as a licensed
13 teacher until a licensed counselor has submitted a letter to the Commission that he does not
.1 pose a threat to students. This order shall serve as the Public Reprimand.
