1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 MICHAEL LINN CAHILL ) ORDER OF REPRIMAND 6 On or about October 9, 2006 the Teacher Standards and Practices Commission 7 (Commission) received a report from the McMinnville School District that Michael Linn Cahill 8 (Cahill) failed to report a situation of child abuse. 9 Mr. Cahill fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Mr. Cahill and the Executive Director agree that their respective interests, 11 together with the public interest, are best served by a stipulation to certain facts and a public 12 reprimand. 13 This Order sets forth the facts upon which the parties have agreed and the sanction to 14 be imposed. Mr. Cahill stipulates that there are sufficient facts contained in the Commission‘s 15 files and records to support the findings of fact and conclusion of law set forth below. In 16 entering into this stipulation, Mr. Cahill waives the right to a hearing to contest the findings of 17 fact, conclusion of law and order set forth below. 18 This stipulation is contingent upon approval and adoption of the Order by the 19 Commission. lf the Commission does not adopt this Order, neither Mr. Cahill nor the 20 Commission are bound by these Stipulations, and Mr. Cahill retains all rights to a hearing on the 21 allegations. 22 STIPULATION OF FACTS 23 1. Mr. Cahill currently holds a Standard Teaching License with an endorsement in 24 Standard Social Studies, issued May 3, 2004 which expires May 15, 2009. 25 2. Mr. Cahill retired from the McMinviIIe School District in June of 2006. Mr. Cahill 26 continued to work for the district on an extra-duty contract as a football coach. 27 3. On October 3, 2006 Mr. Cahill became aware of a relationship between his son, an 28 adult volunteer coach and a 16 year-old female team manager. Mr. Cahill did not report or confirm this report with school officials until he was 4 questioned by the Athletic Director on October 6, 2006. This misconduct constitutes Gross Neglect of Duty in violation OAR 584-020- 18 0040(4)(n) as it incorporates OAR 584-020-0010(5) and 584-020-0025(3)(a). The 19 Commission's authority to impose discipline in this matter is based upon ORS 342.175. 20 ORDER 21 The Commission hereby adopts the above findings of fact and imposes a Public 22 Reprimand upon the Licensure of Michael Linn Cahill.
