1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) FINAL ORDER OF REPREMAND 5 DEANNA ALLAIN E GREEN ) AND PROBATION g On or about April 27, 2011, the Teacher Standards and Practices Commission 8 (Commission), received a report from the Sweet Home School District alleging 9 professional misconduct on the part of licensed educator, Deanna Allaine Green (Green). 1 0 After review of the matters alleged, Green and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a Public Reprimand and four year Probation. 13 By signing below, Green acknowledges, understands, stipulates, and agrees to the 14 following: (i) she has been fully advised of her rights to notice and a hearing to contest 15 the findings of fact, conclusions of law, and order set forth below, and fully and finally 16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 17 Facts and Final Order of Reprirnand and Probation (Stipulation and Final Order); (ii) 18 this Stipulation and Final Order is a public document and disclosed to the public upon 19 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 20 subject to approval and adoption by the Commission. The Commission has licensed Green since October 26, 1996. Green’s current ‘ 3 Basic Teaching License, with an endorsement in Basic Elementary Education ‘ 4 (016), issued on July 27, 2009, expires on July 26, 2012. Green made timely i 5 application for renewal on July 25, 2012 and her license remains active during 6 the application grace period. During all relevant times, Green was employed by 7 the Sweet Home School District. 8 2. On April 21, 2011, Green, while off duty, attended a school play at the High 9 School of the Sweet Home School District. Prior to the play, Green had consumed 1 O alcohol during her meal and had been taking over the counter cold medication 1 1 throughout the day. Several employees and patrons reported to school 12 administrators that Green smelled of alcohol during the event and appeared 13 intoxicated. Green was described as disoriented, unsteady, and emotional by 14 witnesses. Green smelled of alcohol and exhibited signs of intoxication while she 27 interacted with students, patrons and other employees at the event. Green’s interactions 28 resulted in multiple complaint reports to the administration. This conduct constitutes 29 gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it 3O incorporates OAR 584-020-001o(5) (Use professional judgment); OAR 584-020- 31 oo40(4)(o) as it incorporates OAR 584-020-0035(1)(c)(D)(H0nor-ing appropriate adult 32 boundaries with students in conduct and conversations at all times); OAR 584-020- Page 2 STIPULATION OF FACTS AND ORDER OF REPRIMAND AND PROBATION — GREEN, DEANNA 1 0040(4)(g) (Appearing on duty 0r at any district-sponsored activity while under the 2 influence of alcohol or any controlled substance). 3 The Commission’s authority to impose discipline in this matter is based upon 4 ORS 342.175. 5 ORDER - 6 Based on the foregoing, the Commission hereby orders as follows: 7 1. The Commission adopts and incorporates herein the above findings of fact and 8 conclusions of law, and based thereon, imposes a Public Reprimand on 9 Deanna Allaine Green’s Basic Teaching License; 1O 2. Green is hereby placed on probation for a periodiof four (4) years from the date . 1 1 this order is signed by the Commission subject to the following conditions: 12 a. Within six (6) months of this order, Green will submit documentation that 13 she has undergone an evaluation by a chemical dependency professional 14 acceptable to the Commission. This evaluator shall provide a written 15 evaluation report to the Commission. Green shall, at her own initiative 16 and expense, comply with any treatment and/ or counseling 17 recommended by the individual who completed the evaluation described 18 above. Green shall authorize and sign any consent forms necessary for 19 the treatment provider or counselor to furnish records to or discuss 20 Green’s treatment with the Commission. 21 b.
