1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF REVOCATION 5 Teaching License of ) OF RIGHT TO APPLY FOR 6 LAURA MICHELLE CHAFFEY ) LICENSURE 7 8 9 On June 19, 2008, the Teacher Standards and Practices Commission (Commission) issued a 10 Notice of Opportunity for Hearing to Laura Michelle Chaffey (Chaffey) in which the Commission 11 charged her with misconduct under ORS 342.177(3). The Notice was sent via U.S. First Class Mail 12 and U.S. Certified Mail Receipt 7006 2760 0000 1638 5360 to the address on file with the 13 Commission. The U.S. First Class Mail receipt was returned to the Commission July 2, 2008 signed 14 by Laura M Chaffey. The Notice of Opportunity of Hearing, dated June 19, 2008, and signed by 15 Victoria Chamberlain, Executive Director, stated: 16 "You, Laura Michelle Chaffey, are entitled to a hearing on the proposed action of the 17 Commission. If you want a hearing, you must file a written request for a hearing with 18 the Commission within 21 days of the date of this notice. Attached to this notice is a 19 copy of the procedures, right of representation and other rights of parties relating to the 20 conduct of a hearing as required under ORS 183.413(2)." 21 22 Ms. Chaffey did not request a hearing. The Commission, therefore, finds 23 Ms. Chaffey to be in default and enters the following findings of fact, conclusions of law and 24 order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Ms. Chaffey often used school district computer in the furtherance of her Mary Kay cosmetics 27 business. This conduct constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(a). 28 (Knowing and substantial unauthorized use of: school name or financial credit; school materials or 29 equipment for personal purposes; or school personnel to provide personal services unrelated to 30 school business). 31 2. Ms. Chaffey often used school district computers in the furtherance of her Mary Kay cosmetics 32 business during student contact hours. This conduct constitutes gross neglect of duty in violation of 33 OAR 584-020-0040(4)(b) (Knowing and substantial unauthorized use of employment time or school 1 - DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY FOR LICENSE ~ CHAFFEY 1 resources for private purposes). 2 3. Ms. Chaffey falsified a sick leave request form in order to attend a Mary Kay conference. This 3 conduct constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(c). (Knowing 4 falsification of any document or knowing misrepresentation directly related to Iicensure, employment, 5 or professional duties). 6 CONCLUSIONS OF LAW 7 Ms. Chaffey’s use of school computers during class time for personal business constitutes 8 gross neglect of duty in violation with OAR 584-020-0040(4)(a) and (b).
