5 JASON DEAN POOL ) OF RIGHT TO APPLY
6 On May 14, 2002, the Teacher Standards and Practices Commission (Commission)
7 received a report from Craig Roessler, Superintendent, Silver Falls School District indicating
8 that Jason Dean Pool (Pool) was placed on administrative leave pending the outcome of an
9 investigation of alleged misconduct.
10 After review of the matters alleged, Mr. Pool and the Commission agree that their
11 respective interests, together with the public interest, are best served by a stipulation to certain
12 facts and a revocation of his right to apply for a teaching license.
13 This Order sets forth the facts upon which the parties have agreed and the sanction to
14 be imposed. Mr. Pool stipulates that there are sufficient facts contained in the Commission's
15 files and records to support the findings of fact and conclusions of law set forth below. In
.1 entering into this stipulation, Mr. Pool waives the right to a hearing to contest the findings of fact,
17 conclusions of law and order set forth below.
18 This stipulation is contingent upon approval and adoption of the Order by the
19 Commission. If the Commission does not adopt this Order, neither Mr. Pool nor the
20 Commission are bound by these Stipulations and Mr. Pool retains all rights to a hearing on the
21 allegations.
22 STIPULATION OF FACTS
23 1. The Commission issued Mr. Pool a Basic Teaching License with a Basic Language
24 Arts Endorsement on June 9, 1999, this license expired on June 25, 2002.
25 2. Mr. Pool was employed by Silver Falls School District as a teacher at Mark Twain
26 Middle School beginning December 19, 1995. The District placed Mr. Pool on administrative
27 leave March 18, 2002.

1 3. On January 2, 2003, Mr. Pool pied guilty and was convicted of Harassment in Marion
"' County Circuit Court. The Harassment conviction was based upon information that Mr. Pool
3 kissed KS, a fifteen year old female student attending Mark Twain Middle School thus
4 subjecting her to offensive physical contact.
5 4. Several female students who attended Mark Twain Middle School reported
6 information to police indicating that Mr. Pool failed to maintain professional student-teacher
7 relationships with them.
8 5. LS, an 8"h grade femaie student attending iviark Twain Middle Schooi reported to
9 police that Mr. Pool tried to kiss her in his home.
10 6. Mr. Pool was not charged with any criminal conduct regarding stipulations number 4
11 and 5 above.

20 Jason Dean Pool failed to maintain professional student-teacher relationships with
21 female students attending Mark Twain Middle School in violation of OAR 584-020-0035(1)(c).
22 Jason Dean Pool engaged in sexual conduct with, KS, a female student attending Mark Twain
23 Middle School in violation of OAR 584-020-0040(4)(f). This misconduct constitutes Gross
24 Neglect of Duty. Jason Dean Pool‘s criminal conviction for Harassment constitutes Gross
25 Unfitness as defined in OAR 584-020-0040(5)(c). The Commission’s authority to impose
26 discipline in this matter is based upon ORS 342.175.

1 ORDER
. The Commission adopts the above Stipulation of Facts and revokes the right of Jason

3 Dean Pool to apply for an Oregon Teaching License for a period of one year effective
4 January 9, 2004. /
5 IT IS SO ORDERED this [15 day of January 2004.
