1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) STIPULATION OF FACTS, 5 Teaching License of ) ORDER OF REPRIMAND (75 PETER PAUL LUCAS g AND PROBATION 8 On or about January 22, 2001, the Teacher Standards and Practices 9 Commission (Commission) received a report from Gary Peterson, Superintendent, 1O Crook County School District indicating that the Peter Paul Lucas (Mr. Lucas) was 11 reprimanded for inappropriate conduct regarding a confrontation with a student during a 12 wrestling competition. The records indicate that the parents of the student reported to 13 police that Lucas assaulted their son. No criminal charges were filed in this matter. 14 Mr. Lucas fully cooperated with the Commission’s investigation. After review of 15 the matters alleged, Mr. Lucas and the Commission agree that their respective 16 interests, together with the publicinterest, are best served by a stipulation to certain 17 facts and the imposition of a Public Reprimand, followed by a period of probation of two 18 (2) years. This Order sets forth the facts upon which the parties have agreed and the 19 sanction to be imposed. ln entering into this stipulation, Mr. Lucas waives the right to a 20 hearing to contest the findings of fact, conclusion of law and order set forth below. 21 STIPULATION OF FACTS 22 1. Mr. Lucas holds a Standard Oregon Teaching License with Standard Physical 23 Education Endorsement valid until September 18, 2002. There are no prior complaints 24 on file with the Commission. 25 2. Mr. Lucas is currently employed by the Crook County School District. He 26 began his employment with the District in 1992. Mr. Lucas successfully completed a twelve week anger management 4 program sponsored by the Crook County Mental Health Program on January 26, 2001. 5 4. On or about January 5, 2001, Mr. Lucas became angry over a verbal 6 comment a student on the wrestling team made to a referee and confronted the student 7 in the hallway outside the gymnasium during the wresting tournament. Mr. Lucas 8 placed his hands on the student's shoulders in an effort to prevent the student from 9 walking away during the confrontation. 1O 5. In an effort to move the confrontation from the hallway into the locker room 11 Mr. Lucas placed his hands on the students arm. In the locker room Mr. Lucas yelled 12 at the student in an angry manner and used the word “ass.” .13 6. Mr. Lucas accepts responsibility for his behavior and acknowledges his 14 behavior was inappropriate. 15 This stipulation is contingent upon approval and adoption of the Order by the 16 Commission. Lucas’ use of physical force violated OAR 584-020- 5 0040(4)(d). 6 ORDER 7 The Commission imposes a Public Reprimand on Mr. Lucas. This Stipulation of 8 Facts, Order and Probation constitutes the Reprimand. Furthermore, the Commission 9 imposes a two (2) year probation upon Mr. Lucas subject to the following condition: 10 1.
