PEERSON STIPULATION OF FACTS, REPRIMAND AND 4 ORDER 5 6 On or about May 15, 1998, the Teacher Standards and Practices Commission 7 (Commission) issued a Notice of Opportunity for hearing to Donald W. Peerson (Peerson) in 8 which the Commission proposed to suspend or revoke his Oregon Teaching License or to impose 9 other discipline under ORS 342.177. The Commission’s action was based on allegations that 10 Peerson engaged in inappropriate verbal comments, had an overly personal relationship with a 11 student and had made false statements. 12 The Commission and Peerson have now more fully reviewed the matters and have agreed ‘ 13 to the below described stipulation. A decision to compromise and settle this matter is in the 14 parties mutual interest and in the public interest. In entering this stipulation, Peerson waives his 15 right to a hearing. This agreement sets forth the facts Peerson will not contest, including the 16 Commission Order of a Public Reprimand. 17 STIPULTION OF FACTS i8 1. On occasions and in the presence of students Peerson used inappropriate language 19 including slang and profanity. School District Administration put him on written notice of 20 communication expectations in January and February 1997. 21 2. The district received a complaint on or about June 1997 regarding an 22 inappropriate oral comment Peerson was alleged to have made. Peerson resigned on June 20, 1997, after the Superintendent advised him of the 2 complaint. 3 4. Peerson made a false statement on or about June 30, 1997, on his application for 4 renewal of licensure regarding his resignation from Vemonia High School when he denied his 5 resignation was related to a possible investigation of misconduct. 6 5. Peerson made the statement on the application with the belief the statement was 7 more true than false. Peerson had this belief because he had already planned to resign and for 8 the further reason that he believed the Superintendent was not going to conduct an investigation 9 if Peerson resigned. 10 6. Peerson now admits that the statement on the application contained false elements 11 and he recognizes he should have made a disclosure to TSPC and included an explanation. 12 Peerson enters into this Stipulation of Facts with knowledge that the Commission will . 13 issue a public reprimand. This Stipulation is contingent upon approval and adoption of the Order 14 by the Commission. If the Commission does not adopt this Order, neither Peerson nor the 15 Commission are bound by these stipulations and Peerson retains all rights to a hearing on the 16 allegations. Salem, 0R 97310 (sos) 3112-6003 ‘ . 1 CONCLUSIONS 0F LAW 2 Under ORS 342.175 Peerson violated OAR 584-020-0030(2)(b); 0035 (3)(a); 0040(4)(c) 3 when he made inappropriate verbal comments in the presence of students and made a false 4 statement on his application for license renewal. 5 ORDER 6 The Commission adopts the above Findings of Fact and reprimands Peerson for his 7 inappropriate verbal comments and false statement as described above. Peerson will be placed 8 on probation for a period of two years from the date of this order pursuant to ORS 342.177(3)('o). 9 The terms of probation are: l. Peerson will comply with the standards for ethical and competent 10 performance of Oregon educators under OAR 584 Division 20. 2.
