. 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ 2 OF THE STATE OF OREGON 3 In the Matter of the Teaching License of ) STIPULATION OF FACTS 4 ) AND ORDER OF SUSPENSION 5 SANDRA LYNN TWEED ) 6 ' ) 7 On or about August 18, 2001, the Teacher Standards and Practices Commission 8 (Commission) received a report from Craig Brewington, Superintendent, Warrenton-Hammond 9 School District indicating that Sandra Lynn Tweed (Tweed), a licensed teacher, engaged in 10 inappropriate use of school district equipment and employment time for personal purposes. 11 Ms. Tweed fully cooperated with the Commission's investigation and did not contest the 12 allegations. After review of the matters alleged, Ms. Tweed and the Commission agree that 13 their respective interests, together with the public interest, are best served by a stipulation to 14 certain facts and a ninety (90) day suspension of her Standard Teacher License. This Order >15 sets forth the facts upon which the parties have agreed and the sanction to be imposed. In 16 entering into this stipulation, Ms. Tweed waives the right to a hearing to contest the finding of 17 fact, conclusion of law and order set forth below. This stipulation is contingent upon approval 18 and adoption of the Order by the Commission. If the Commission does not adopt this Order, 19 neither Ms. Tweed nor the Commission are bound by these Stipulations and Ms. Tweed retains 20 all rights to a hearing on the allegations. 21 STIPULATION 0F FACTS 22 1. Ms. Tweed holds a Standard Teaching License issued May 1, 1997 valid through 23 May 31, 2002, with Endorsements in Basic Biology; Basic Chemistry; and Basic Physics. The 24 Commission has continually licensed Ms. Tweed since August 14, 1992. There are no prior 25 complaints on file. 26 2. Ms. Tweed was employed by Warrenton-Hammond School District from September 27 of 1992 until resignation from her teaching position effective October 19, 2001. Ms. Tweed Page 1 STIPULATION OF FACTS, ORDER OF SUSPENSION - TWEED 1 received outstanding teacher evaluations during her employment as a Science Teacher at ’ 2 Warrenton High School. 3 3. A District-owned computer with Internet access was present in Ms. Tweed's 4 classroom for her use in connection with her assigned responsibilities. 5 4. During the 2000-2001 school year Ms. Tweed used her classroom computer and the 6 Districts Internet connection to create and send over 300 personal email messages to an 7 individual outside the District during the work day, including student contact hours, non-student 8 contact hours and her lunch time. 9 5. Ms. Tweed admits that she should not have used District computer equipment and 10 student contact hours for engaging in extensive personal business and has expressed remorse 11 for doing so. 12 6. Ms. Tweed has never denied her actions with the School District or Commission. 13 She has accepted responsibility and acknowledges her mistake. ‘14 7. Ms. Tweed was O Page 2 STIPULATION OF FACTS, ORDER OF SUSPENSION - TWEED 1 fully aware that her use of District owned computer equipment and employment time for . 2 personal purposes was Inappropriate and in violation of District policy. 3 CONCLUSION OF LAW 4 Sandra Lynn Tweed’s activities constitute Gross Neglect of Duty in violation of OAR 584- 5 020-0040(4)(a) and OAR 584-020-0040(4)(b). 6 ORDER 7 The Oregon Standard Teacher License, certificate number 285498, issued to Sandra 8 Lynn Tweed is suspended for a period of ninety (90) days beginning on November 16, 2001.
