Before a hearing date was set, 13 the parties have agreed that their respective interest and the interests of the State are l4 best served by a Stipulation of Facts and Order of Public Reprimand and Probation as 15 set forth below. 16 l7 STIPULATION OF FACTS 18 19 1. Lyudmila Tsytsyn (DOB 05-21-74) immigrated from the Ukraine to the United 20 States with her family in 1991 The family established a residence in 21 Vancouver, Washington. 22 23 2. Ms. Tsytsyn was convicted in October 1995 in Clark County Washington on 24 Theft in the Second Degree (a felony) for theft: of cash fr0rn Sears Roebuck where 25 she was employed. - 26 27 3. Ms. Tsytsyn was required to pay financial obligations, complete community 28 service and serve a. period of probation which ended Juh! 8, 1998. 29 30 4. Ms. Tsytsyn enrolled at George Fox University in Fall 1993 as an undergraduate. 31 She was continuously enrolled as a full-time student through spring 1998 and 32 earned a Bachelor of Arts on May 1, 1998 with a major in music teaching. 33 34 5. Ms. Tsytsyn did not disclose to George Fox University that she had been 35 convicted for Theft. She answered "no" to all TSPC character questions On her 36 PA-l form when registering for student teaching on December 3, 1997. 37 38_ 6. Ms. Tsytsyn answered "no" to all TSPC character questions on an application for 39 licensure dated June 23. 1998. 40 41 7. Tigard-Tualatin School District offered Ms. Tsytsyn a position for 1998-99 as a 42 music teacher. She answered "no" to the district's question, "Have you ever 43 been convicted or plead nolo oontendre to a felony?" 44 ' 45 8. TSPC became aware of the arrest from the FBI report on fingerprints and 46 investigated the court disposition. Ms. Tsytsyn cooperated by providing court 47 documents and by subsequent full disclosure to Tigard-Tusiatin School District 48 administrators. - 49 50 9. Ms. Tsytsyn has conducted herself in an appropriate manner in the George Fox 51 University Teacher Education Pregram and has favorable recommendations from 52 program faculty and cooperating school personnel. This Stipulation is contingent upon approval and 4 adoption of the Order by the Commission. She 2A answered "no" to character questions at admission to student teaching and on 25 applications for lieensure and employment with Tigard-hialatin School District. 26 27 CONCLUSIONS OF LAW 28 ‘ 29 Under ORS 342.175 and OAR 584. Division 20 required educators to be law-abiding 30 citizens and to exemplify personal integrity and honesty. 31 32 ORDER 33 34 The Commission confirms issuance of a Teaching License to Lyudmila Tsytsyn for ~ 35 employment in Tigsrd-Tualatin School District. The Commission issues a. Public 36 Reprimand for failure to disclose this conviction to George Fox University, 37 Tigard-Tualatin School District and the Commission and this Order shall serve 38 as the Reprimand. Ms. Tsytsy'n shall be on probation from September l 1, 1998 39 to September 1 l, 2000.
