DALE BRADY ) l On July 26, 1993. the Teacher Standards and Practices Commission ("Commission") issued a Notice of Opportunity for Hearing on the proposed decision to deny reissuance of the teaching license of C. Dale Brady ("Brady"). Thereafter. Brady agreed to stipulate to the facts set forth below and to the entry of an order suspending his license for 60 days followed by a period of probation for two years, during which time Brady must present evidence to the Commission of counseling relating to his conviction of theft in the second degree. In entering this stipulation. Brady waives his right to a hearing to contest any of the findings and conclusions set forth below. STIPUIATED FACTS g Brady and the Commission stipulate as follows: l. Brady currently holds an Oregon teaching license. 2. Brady was employed as a teacher in the Clackamas County School District No. 46 from 1986 until July, 1993. 3. Brady plead guilty to the charge of theft in the second degree on or about , June 22, 1993. > 4. Brady fully cooperated with security and law enforcement oflicials in the investigation of the charges. 5. Following his entry of a guilty plea. Brady voluntarily entered counseling at the Cascade Counseling Clinic. Brady also voluntarily resigned his‘ teaching . position from the school district on or about July 9, 1993. _ 6. The Conduct described in paragraphs 1 through 5 about constitutes gross unfitness under ORS 3423.175. The parties acknowledge that upon execution of this stipulation. the Commission will enter an order suspending Brady’s teaching license for 60 days and place Brady on probation for two years thereafier. The stipulation and proposed order are contingent upon approval by the full Commission at the Commission's meeting scheduled for September 23-24, 1993. If the Commission does not approve the stipulation, the Commission may take further appropriate action. including setting the matter for hearing on the proposed denial. In such event. neither Brady nor the Commission shall be bound by any matters contained in the stipulation and nothing in this stipulation shall be used against either party. Dale Brady is suspended for a period of 60 days retroactive to June 22. 1993, and continuing through August 21, 1993. Following the period of suspension, Brady‘s teaching license shall be reactivated on a probationary basis. if the Executive Secretary has no evidence that Brady has violated any criminal laws or violated any standards for competent and ethical performance under OAR 584-, Division 20. 2. Brady‘s probation shall remain in effect for a period of two years. Brady’s probation shall be subject to the following conditions: (a) Brady shall not violate any criminal laws and shall comply with all standards for competent and ethical performance of Oregon educators under OAR ‘ 584. Division 20: _ (b) Brady shall report in writing to the Executive Secretary if he has been arrested or charged with a crime or convicted of a crime. within 20 days of the charge, arrest or conviction; (c) Brady shall continue his current enrollment in a counseling program subject to the diagnosis and advise of his (are provider concerning any conditions that may have led to his conviction for second degree theft.
