9 On July 22, 1997 the Teacher Standards and Practices Commission issued a
10 Temporary Teaching License to Susan Lee Kettler, contingent upon clearance of the
11 fingerprint cards submitted with her application. Ms. Kettler's fingerprint cards were
12 rejected by the Oregon State Police or the FBI. Kettler has been notified at least twice
13 by U.S. Certified Mail-~Retum Receipt Requested and U.S. First Class Mail that new
14 prints are required for resubmission, but she has not responded to the re-requests.

16 FINDINGS OF FACT

18 1. Susan Lee Kettler has applied for licensure and was issued a Temporary
19 Teaching License pending clearance of fingerprints by the Oregon State Police
20 and FBI.

, 22 2. TSPC informed Ms. Kettler by U.S. Certified Mail--Return Receipt Requested
23 and U.S. First Class Mail that her fingerprint cards had been rejected. The
24 Commission provided at least 21 days for the applicant to respond.

\ 26 3. Kettlerihas not responded to TSPC notices requesting resubmission of
27 fmgerprint cards.

29 CONCLUSIONS OF LAW

31 Refusal to be fingerprinted is grounds for denial of licensure under ORS 342.223(2).

35 The Commission suspends the Temporary Teaching License #299306,issued to Susan
36 Lee Kettler, , for failure to comply with fingerprint requirement.
37 Suspension to continue until fingerprint requirement is met.
