5 JOSEPH ANTHONY HERTZ )
6 On or about June 15, 2005, the Teacher Standards and Practices Commission
7 (Commission) received an application for reinstatement of a revoked Standard Personnel
8 Service License from Joseph Anthony Hertz (Hertz). Said license was revoked by order of the
9 Commission on March 24, 1997. The Commission considered Mr. Hertz‘ application under the
10 procedures set forth in OAR 584-050-0015. Mr. Hertz appeared personally before the
11 Commission on January 27, 2006. After considering Mr. Hertz’ application and supporting
12 materials as well as the recommendation of the Executive Director the Commission makes the
13 following findings of fact and order.
14 FINDINGS OF FACT '
. 1. The Commission licensed Mr. Hertz beginning in September of 1987, until revocation
16 on March 24, 1997.
17 2. On March 24, 1997, the Commission revoked Mr. Hertz‘ right to apply for a Personnel
18 Service License based upon Gross Unfitness. On September 19, 1994, Hertz pied guilty to the
19 crime of assault in the third degree, a Class C felony in Curry County, Oregon.
20 3, On June 15, 2005, Mr. Hertz submitted application requesting reinstatement ofa
21 revoked Standard Personnel Service License.
22 4. On January 26, 2006, the Commission met with Mr. Hertz personally and reviewed
23 the application materials Mr. Hertz submitted in support of reinstatement pursuant to OAR 584-
24 050-0015(4). The Commission approved the reinstatement of Iicensure for Mr. Hertz based
25 upon convincing evidence of fitness to serve as an educator.

1 CONCLUSION OF LAW
.2 Mr. Hertz provided sufficient evidence to establish convincingly that he possesses the
3 qualifications required for reinstatement of his Standard Personnel Services License pursuant to
4 OAR 584-050-0015(4).
5 ORDER
6 The Standard Personnel Service License of Joseph Anthony Hertz is hereby reinstated.
7 IT IS SO ORDERED this Q day of February, 2006.
