‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS g ELVIE ISAAC BRINSON ) AND ORDER OF REPRIMAND 7 On or about November 25, 2002, the Teacher Standards and Practices 8 Commission (Commission) received a report from Maria Delapoer, Human Resources 9 Director, Greater Albany Public Schools, alleging that Elvie Isaac Brinson (Brinson) 1O used intimidating and menacing behavior towards a student on October 31, 2002. After 11 review of the matters alleged, Mr. Brinson and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition of a Public Reprimand. Mr. Brinson fully cooperated . with the Commission's investigation and did not contest the allegations. 15 This Order sets forth the facts upon which the parties have agreed and the 16 sanction to be imposed. Mr. Brinson stipulates that there are sufficient facts contained 17 in the Commission's files and records to support the findings of fact and conclusions of 18 law set forth below. In entering into this stipulation, Mr. Brinson waives the right to a 19 hearing to contest the finding of fact, conclusion of law and order set forth below. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Brinson nor the 22 Commission are bound by these Stipulations and Mr. Brinson retains all rights to a 23 hearing on the allegations. 24 STIPULATION OF FACTS . 1. Mr. Brinson has been licensed by the Commission since July 23, 1985. Mr. Brinson is employed as a teacher for South Albany High School, Greater 5 Albany Public School District. He began his employment with the District in September 6 of 1989. 7 3. On October 31, 2002, at South Albany High School, Mr. Brinson exhibited 8 poorjudgment in displaying a knife in his classroom and pretending to cut the wires on 9 a students stereo headset. 1O 4. This misconduct constitutes Gross Unfitness.
