1 NOTICE OF OPPORTUNITY FOR HEARING ' 2 BEFORE THE TEACHER STANDARDS AND PRACTICES COM]\/flSSION 3 OF THE STATE OF OREGON 4 In the Matter of the Teaching License of 5 DEFAULT ORDER DOYLE WILSON 6 . 7 On May 20, 1999, the Oregon Teacher Standards and Practices Commission 8 (Commission) issued a Notice of Opportunity for Hearing to Doyle Wilson in which the 9 Commission proposed to suspend or revoke the teaching license of Mr. Wilson or otherwise 10 impose discipline under ORS 342.177 based on an allegation that Mr. Wilson used school district 11 computers to access sexually explicit materials‘ Mr‘ Wilson requested a hearing. Pursuant to 12 negotiations, Mr. Wilson withdrew his request for a hearing on October 12, 1999, and consented ' 13 that the Commission enter an Order ofDefaultr The Commission, therefore finds Mr. Wilson to 14 be in default, and based on the record in this case, enters the findings, conclusions and order set 15 forth below. 16 FINDINGS 0F FACT l7 l, Mr. Wilson holds a Standard Oregon Teaching License. He was employed as a 18 teacher with the Beaverton School District from September 1988 until March 31, 1998 when he l9 resigned his position with the district. 20 2. In March 1998, a middle school student at the Meadow Park Middle School saw 21 Mr‘ Wilson viewing sexual materials on a computer located in the computer lab of the school‘ 22 Subsequently, Mr. Wilson admitted that he had used school district computer equipment to 23 access sexually explicit materials through the Internet. I Page l - DEFAULT ORDER JGMthh\GEN3 1696.DOC Department of Justice 1162 Court Street NE Salem, OR 97310 (503) 3786003 . 1 ULTIMATE FlNDING OF FACT 2 Doyle Wilson used computer equipment owned by his employing school district and 3 located on school district premises to access sexually explicit materials without authorization 4 from the district‘ 5 CONCLUSION OF LAW 6 The above conduct constitutes gross neglect of duty in violation of OAR 584-020- 7 0040(4)(a). 8 DISCUSSION 9 Use of school computer equipment to access pornographic materials is a serious violation 10 of Commission standards‘ This use of school property is inconsistent with the educational 11 mission of the school and has a negative affect of the public image of the school in the . 12 community‘ A suspension of Mr‘ Wilson’s license is appropriate under the circumstances. 13 ORDER 14 The Commission imposes a suspension of the Oregon Teaching License of Doyle Wilson 15 for a period of 30 days from the date of this Order. Following the suspension, Mr, Wilson’s 16 license may be reinstated if he shows evidence that he has undergone an evaluation at his own 17 expense by a medical professional acceptable to the Commission, and the evaluator submits a 18 written report to the Commission attesting that Mr. Wilson is fit to work with children and l9 teenagers and that there is a high probability he will not use school district equipment to access 20 pornography or engage in similar inappropriate behavior‘ Upon reinstatement, Mr Wilson shall 21 be placed on probation for a period of two years subject to the following conditions: I 22 /// 23 /// . Mr. Wilson shall comply with all Standards for Competent and Ethical 2 Performance of Oregon Educators under OAR 584, Division 020. 3 2. Mr. Wilson shall participate in counseling or treatment as recommended by the 4 medical professional who conducted the evaluation described above. 5 3.
