.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) ORDER OF REPRIMAND 5 GUY STANLEY ORCUTT ) 6 On or about March 8, 2004, the Teacher Standards and Practices Commission 7 (Commission) received a report from Maureen R. Sloane, Human Resources Counsel, 8 Portland Public Schools indicating that Guy Stanley Orcutt (Orcutt) may have violated 9 standards required of teachers by failing to comply with the Oregon Department of 1O Education's test security requirements. 11 After review of the matters alleged, Mr. Orcutt and the Commission agree that 12 their respective interests, together with the public interest, are best served by a stipulation to certain facts and the imposition of a Public Reprimand. it This Order sets forth the facts upon which the parties have agreed and the 15 sanction to be imposed. Mr. Orcutt stipulates that there are sufficient facts contained in 16 the Commission's files and records to support the findings of fact and conclusions of law 17 set forth below. In entering into this stipulation, Mr. Orcutt waives the right to a hearing 18 to contest the findings of fact, conclusion of law and order set forth below. 19 This Stipulation is contingent upon approval and adoption of the Order by the full 20 Commission. If the Commission does not adopt this Order, neither Mr. Orcutt nor the 21 Commission are bound by these stipulations and Mr. Orcutt retains the right to a 22 hearing on the allegations. Mr. Orcutt holds a Standard Teaching License valid November 2, 2001, 3 through September 27, 2006, with Standard Language Arts and Social Studies 4 Endorsements. 5 2. Mr. Orcutt is currently employed as a teacher at Wilson High School, Portland 6 Public Schools. 7 3. During the period of January 4, 2004, through February 25, 2004, Mr. Orcutt 8 failed to comply with the Oregon Department of Education's test security requirements 9 in administering the CIM test by permitting students to remove the tests from the school 10 grounds. 11 4. This misconduct constitutes Gross Neglect of 22 Duty pursuant to OAR 584-020-0040(4)(n) The Commission's authority to impose 23 discipline in this matter is based upon ORS 342.175.
