OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 GREGORY ALLAN ELLARS ) 6 On or about January 2, 2006, the Teacher Standards and Practices Commission 7 (Commission) received an application for renewal of an Initial Teaching License from Gregory 8 Allan Ellars (Ellars) in which he responded “no” to all character questions. A fingerprint inquiry 9 and response from the Oregon State Police revealed that on December 6, 2005, Mr. Ellars was 1O convicted of Assault IV in Clackamas County. 11 Mr. Ellars fully cooperated with the Commission's investigation. After review of the 12 matters alleged, Mr. Ellars and the Commission agree that their respective interests, together 13 with the public interest, are best served by a stipulation to certain facts and imposition of a 14 public reprimand. ’ This document sets forth the facts upon which the parties have agreed and the 16 stipulated sanction to be imposed. Mr. Ellars stipulates that there is sufficient evidence in the 17 Commissions files and records to support the findings of fact, conclusions of law, and order set 18 forth below. 19 By signing below, Mr. Ellars acknowledges, understands, stipulates, and agrees to the 20 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 21 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 22 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 23 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 24 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 25 Finat Order is contingent upon and subject to approval and adoption by the Commission. if the 26 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. ‘ Ellars nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - ELLARS ‘ . 1 and Final Order, and understands it completely; (v) he voluntarily, without any force or duress, '1 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 3 Final Order below; (vi) he states that no promises or representation has been made to induce 4 him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney 5 regarding this Stipulation and Final Order and has been fully advised with regard to his rights 6 thereto, or waives any and all rights to consult with an attorney prior to entering into this 7 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 8 STIPULATION 0F FACTS 9 1. Mr. Ellars has been licensed by the Commission since January 18, 1980. Mr. Ellars 10 holds an Initial Teaching License issued April 5, 2006, valid through April 4, 2010, with English 11 for Speakers of Other Languages and Language Arts endorsements. 12 2. Mr. Ellars has been employed by Portland Public Schools since January 20, 1980. In 13 his 26 years of teaching, Mr. Ellars has never been the subject of a complaint or report. ‘i 3. On January 2, 2006, Mr. Ellars signed and submitted an application for renewal of 15 Iicensure. Mr. Ellars made a false statement on his application for renewal of a teaching license 16 when he responded "no" to character question 8, “Have you ever been convicted or been 17 granted conditional discharge by any court for: (a) any felony; (b) misdemeanor...?" Mr. Ellars 18 failed to disclose his misdemeanor conviction for Assault IV in the Circuit Court of the State of 19 Oregon for the County of Clackamas. 20 4. On January 2, 2006, Mr. Ellars signed and submitted an application for renewal of 21 Iicensure. Mr. Ellars made a false statement on his application for renewal of a teaching license 22 when he responded “no” to character question 10, “Have you ever entered a plea of'guilty or No 23 Contest relative to any charge for an offense listed in Question #8 (above)?” Mr. Ellars failed to 24 disclose that he plead guilty on December 6, 2005, to Assault IV in the Circuit Court of the State 25 of Oregon for the County of Clackamas. , ' /// l Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - ELLARS t I I I I 4 I - 1 /// '1 5. The Commission’s 13 authority to impose discipline in this matter is based upon ORS 342.175. 14 ORDER 15 The Commission hereby adopts and incorporates herein the above findings of facts and '1 imposes a Public Reprimand upon the license of Gregory Allan Ellars.
