1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION g RYAN ALLEN SKOGSTAD g AND PROBATION 7 On or about April 4, 2001, the Teacher Standards and Practices Commission 8 (Commission) received a report from David J. Voves, Superintendent, Dallas School 9 District indicating that Ryan Allen Skogstad, a licensed educator, may have violated 10 Standards by participating in a sexually orientated conversation with a female student. 11 Mr. Skogstad fully cooperated with the Commission's investigation. After review 12 of the matters alleged, Mr. Skogstad and the Commission agree that their respective 13 interests, together with the public interest, are best served by a stipulation to certain 14 facts and an Order of Suspension. This Order sets forth the facts upon which the 15 parties have agreed and the sanction to be imposed. In entering into this stipulation, 16 Mr. Skogstad waives the right to a hearing to contest the findings of fact, conclusion of 17 law and order set forth below. Mr. Skogstad understands that the Commission will 18 accept the surrender of his teaching license and will suspend his right to apply for 19 reinstatement for one (1) year. Mr. Skogstad understands that reinstatement of his 20‘t teaching license after the one (1 ) year period of suspension will be subject to specific 21 conditions and a subsequent four (4) year period of probation. 22 STIPULATION OF FACTS 23 24 1. The Commission issued a Transitional Teaching License, with Basic and 25 Advanced Mathematics endorsements, to Mr. Skogstad on September 29, 2000, valid 26 until September 29, 2003. From August 28, 2000 until his resignation on April 3, 2001, Mr. Skogstad was . 2 employed by the Dallas School District as a High School Math teacher. 3 3. During the week of March 19, 2001, Mr. Skogstad engaged in three 4 conversations with a female high school student at Dallas High School. During the 5 course of these conversations, Mr. Skogstad and the student agreed to a date that the 6 student would come to Mr. Skogstad’s home for the purpose of staying overnight and 7 engaging in sexual activity. 8 4. On March 21, 2001, the student, reported to a Dallas High School staff 9 member that she was considering an offer from Mr. Skogstad to spend the night with 10 him at his home. 11 5. Mr. Skogstad resigned during the school districts investigation of allegations 12 that he had engaged in a sexual conversation with and made sexual advances toward a .13 female student. 14 6. Mr. Skogstad accepted full responsibility for his actions and within a week of 15 his resignation, voluntarily sought professional counseling and group therapy 16 assistance. As of the date of this order, Mr. Skogstad continues to participate in 17 individual counseling once a week and group therapy every week. 18 7. Mr. Skogstad cooperated fully in the Commission's investigation, expressed 19 remorse for his actions, and acknowledges his behavior was inappropriate. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Skogstad nor 22 the Commission are bound by these Stipulations and Mr. Skogstad retains all rights to a 23 hearing on the allegations. Myton Executive Director Date 8 Teacher Standards and Practices Commission 9 CONCLUSION 0F LAW 10 Ryan Allen Skogstad violated OAR 584-020-0040(4)(f) by engaging in 11 conversation regarding sexual acts and inviting student JK to home to spend the night 12 with him. 13 ORDER 14 The Commission suspends the Transitional Teaching License of Ryan Allen 15 Skogstad, certificate number 1004008, effective September 14, 2001, for a period of '16 one year. At the end of this suspension period, Mr. Skogstad’s Teaching License shall 17 be reinstated providing he meets the following conditions: 18 1. Submission of complete application with required supporting documentation 19 and fees in compliance with OAR 584-050-0015; 20 2. Submission of documentation that he has completed (at his own expense), an 21 intensive education program regarding appropriate boundaries with students, including 22 sexual harassment education conducted by a qualified trainer approved in advance by 23 the Commission. This intensive training shall consist of, at least, five (5) one and one- 24 half (1 1/2) hour sessions. Mr. Skogstad shall provide the trainer with a copy of this 25 Order. Submission of documentation that he has undergone an evaluation by a ’ 2 psychotherapist or medical professional acceptable to the Commission. The evaluator 3 shall submit a written report to the Commission attesting (1) Mr. Skogstad is fit to work 4 with children and teenagers, and (2) there is a high probability he wiII not engage in 5 similar inappropriate behavior. Any costs associated with the assessment or treatment 6 will be the responsibility of Mr. Skogstad. 7 Upon reinstatement of his teaching license, Mr. Skogstad shall be placed on 8 probation for a period of four (4) years and subject to the condition that he comply with 9 all Standards for Competent and Ethical Performance under Chapter OAR 584, Division 10 020. 11 Violation of the terms of this probation may constitute an independent basis for 12 the Commission to impose discipline, up to and including revocation of Mr. Skogstad‘s ‘13 teaching license subject to Mr. Skogstads right to a hearing on the issue of whether he 14 violated probation. 15 Dated this [Q7], day of September 2001 16 TEACHER STANDARDS AND PRACTICES COMMISSION 17 W 3‘ 18 By: W 19 David V.
