1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ' OF THE sTATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 BARBARA JEAN STEPHENS ) ORDER OF PROBATION , 6 On August 18, 2004, Barbara Jean Stephens (Stephens) submitted an application for 7 a Transitional Teaching License. Ms. Stephens responded affirmatively to character 8 questions 8 and 10. Ms. Stephens provided documents and an explanation regarding her 9 criminal convictions. 10 After review of the facts in this matter, Ms. Stephens and the Executive Director agree 11 that their respective interests, together with the public interests, are best served by a 12 stipulation to certain facts and a four (4) year probation upon issuance of licensure. 13 This Order sets forth the facts upon which the parties have agreed and the sanction to ‘ be imposed. Ms. Stephens stipulates that there are sufficient facts contained in the 15 Commission’s files and records to support the findings of fact and conclusions of law set forth 16 below. In entering into this stipulation, Ms. Stephens waives the right to a hearing to contest 17 the findings of fact, conclusions of law and order set forth below. Ms. Stephens enters into 18 this agreement with the knowledge that the Commission will impose a probation agreement 19 with specific conditions. 2O This stipulation is contingent upon approval and adoption of the Order by the . 21 Commission. lf the Commission does not adopt this Order, neither Ms. Stephens nor the 22 Commission are bound by these Stipulations and Ms. Stephens retains all rights to a hearing 23 on the allegations. / 24 STIPULATION OF FACTS b 1. On 7%/0 ‘j fithe Commission issued a letter of 3 conditional authorization for public school service. 4 3. On December 19, 2003, Ms. Stephens was convicted of Petty Theft in Shasta County 5 Superior Court, Redding, California. 6 4. On April 26, 2004, Ms. Stephens was convicted of Petty Theft in Shasta County 7 Superior Court, Redding, California. Criminal convictions may be used as 17 evidence to establish an applicants lack of fitness to serve as an educator pursuant to OAR 18 584-050-0006. The Commission’s authority to impose discipline in this matter is based upon 19 ORS 342.143 and ORS 342.175. 2O // / 21 /// 22 /// O Page 2 STIPULATION OF FACTS AND ORDER OF PROBATION — STEPHENS 1 ORDER . The Commission adopts the above Stipulation of Facts and authorizes the issuance of 3 a Transitional Teaching License to Ms. Stephens subject to all standard terms and 4 conditions. 5 Furthermore, the Commission imposes a four (4) year probation upon Ms. Stephens to 6 commence the date of issuance of said license and subject to the following terms and 7 conditions of probation: 8 1. Ms. Stephens shall, at her own initiative and expense undergo an evaluation by a 9 psychotherapist or medical professional acceptable to the Commission. A copy of the 10 evaluation will be mailed to the Commission with a statement regarding the likelihood that 11 Ms. Stephens will not repeat the criminal behavior. 12 2. During the period of her probation, Ms. Stephens shall submit to the Executive . Director of the Commission annual reports of her compliance with any aftercare treatment 14 plan recommended by the medical professional if appropriate on or before: October 8, 2005; 15 October 8, 2006; October 8, 2007; and October 8, 2008; 16 3. Ms. Stephens shall conduct herself as a law-abiding citizen; 17 4. Ms. Stephens shall report in writing within ten days to the Executive Director of the 18 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or 19 violation of criminal probation (July 12, 2004 through July 12, 2007) with the Shasta County 20 Superior Court; 21 5. Ms. Stephens shall notify the Commission upon completion of her criminal 22 probation; and i 23 6. Ms. Stephens shall comply with the Standards for Competent and Ethical ‘ b Performance of Oregon Educators under Oregon Administrative Rules, Chapter 584, Division 25 020.
