1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 CHRISTOPHER JOHN STEWART ) AND PROBATION 6 On or about April 3, 2006, the Teacher Standards and Practices Commission 7 (Commission) received information that Christopher John Stewart (Stewart) was arrested twice 8 for Driving Under the Influence of Intoxicants (DUII). 9 Mr. Stewart fully cooperated with the Commission’s investigation in this matter. After 10 review of the matters alleged, Mr. Stewart and the Commission agree that their respective 1 1 interests, together with the public interest, are best served by a stipulation to certain facts, a 12 reprimand followed by a four (4) year probation. Mr. Stewart understands that the probation will 13 be subject to specific terms and conditions. 14 This document sets forth the facts upon which the parties have agreed and the ' stipulated sanction to be imposed. Mr. Stewart stipulates that there is sufficient evidence in the 16 Commission’s files and records to support the findings of fact, conclusions of law, and order set 17 forth below. 18 By signing below, Mr. Stewart acknowledges, understands, stipulates, and agrees to the 19 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 20 findings of fact, conclusions of Iaw, and order set forth below, and fully and finally waives all 21 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Final Order 22 0f Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is 23 a public document and disclosed to the public upon request by the Commission; (iii) this 24 Stipulation and Final Order is contingent upon and subject to approval and adoption by the ‘ 25 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 3 26 then neither Mr. Stewart nor the Commission are bound by the terms herein; (iv) he has fully ' read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without Page 1 -STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - STEWART 1 any force or duress, enters into this Stipulation and Final Order and consents to issuance and ‘ entry of the Stipulated Final Order below; (vi) he states that no promises or representation has 3 been made to induce his to sign this Stipulation and Final Order; and (vii) he has consulted with 4 an attorney regarding this Stipulation and Final Order and has been fully advised with regard to 5 his rights thereto, or waives any and all rights to consult with an attorney prior to entering into 6 this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 7 STIPULATION OF FACTS 8 1. The Commission licensed Christopher John Stewart beginning January 22, 2002. 9 Mr, Stewart currently holds an Initial Teaching License issued April 5, 2005, valid through April 10 4, 2009, with Language Arts and Multiple Subjects Endorsements. 11 2. Mr. Stewart began employment with Eugene Public Schools on August 28, 2002, and 12 is currently assigned to Churchill High School teaching language arts. 13 3. On February 13, 2000, Mr. Stewart was arrested for Driving Under the Influence of . lntoxicants (DUII) in Eugene, Oregon. The court granted Mr. Stewart a Diversion. Mr. Stewart 15 completed Diversion and On March 22, 2001, the DUII charge was dismissed in Eugene 16 Municipal Court. 17 4. On May 8, 2005, Mr. Stewart was arrested for DUII in Eugene, Oregon. On July 6, 18 2005, Mr. Stewart was convicted of the misdemeanor crime of DUII in Eugene Municipal Court, 19 The Court fined Mr. Stewart $1000 plus costs, suspended his Oregon Driver License for one 20 year and placed him on probation for one year. 21 5. Mr. Stewart recognizes that he has an alcohol dependency problem and has agreed 22 to a plan of treatment and aftercare as prescribed by his treatment provider. 23 IT IS SO STIPULATED AND AGREED TO: 24 Zté? fir 717/Og 25 C rist er J h S ewart t Date 26 MM were G Victoria Cham erlain, Executive Directon _ Date Teacher Standards and Practices Commission Page 2 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - STEWART 1 CONCLUSIONS OF LAW ‘ Christopher John Stewart’s alcohol related criminal conviction and criminal conduct 3 constitute Gross Untitness as defined in OAR 584-020-0040(5)(c) and OAR 584-020- 4 0040(5)(e). The Commission has the authority to impose discipline in this matter is based upon 5 ORS 342.120 through 342.430 and OAR Chapter 584. 6 FINAL ORDER 7 The Commission hereby adopts and incorporates herein the above findings of fact and 8 conclusions of law and hereby imposes a Public Reprimand on Christopher John Stewart. This 9 Order shall serve as the Public Reprimand. 1O Furthermore, the Commission places Mr. Stewart on Probation for a period of four (4) 11 years probation subject to the following terms and conditions: 12 1. Mr. Stewart shall, at his own initiative and expense, continue to obtain treatment for 13 his alcohol dependency as recommended by his alcohol treatment provider and abstain from . the consumption of alcohol; 15 2. During the period of this probation, Mr. Stewart shall submit to the Executive Director 16 of the Commission reports of his compliance with the aftercare treatment plan. Mr. Stewart 17 shall provide these reports every six (6) months during his probation, on or before: February 4, 18 2007; August 4, 2007; February 4, 2008; August 4, 2008; February 4, 2009; August 4, 2009; 19 February 4, 2010; and August 4, 2010. 2O 3. Mr. Stewart shall report in writing within ten days to the Executive Director of the 21 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or 22 violation of criminal probation; and 28 4. Mr. Stewart shall comply with the Standards for Competent and Ethical Performance 24 of Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020.
