.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 LORI ANN CLIFFORD ) FINAL ORDER OF PROBATION g On October 9, 2003, the Teacher Standards and Practices Commission (Commission) 8 adopted a Stipulation of Facts and Probation based upon information that Lori Ann Clifford 9 (Clifford) provided on application for an Initial Teaching License. The terms and conditions of 1O the four (4) year Probation, effective September 4, 2003, included the requirement that Ms. 11 Clifford abstain from consumption of alcohol. On March 13, 2006, the Commission received 12 information that Ms. Clifford violated her probation by consuming alcohol. On March 13, 2006, 13 Ms. CIifford admitted that she relapse from her program of recovery in July of 2005 and was 14 consuming alcohol in violation of probation. 5 Ms. Clifford fully cooperated in the Commission’s investigation of this matter. After Q review of the facts in this matter, Ms. Clifford and the Executive Director agree that their 17 respective interests, together with the public interest, are best served by a stipulation to certain 18 facts, and the continuance of probation for an additional two (2) years. 19 This document sets forth the facts upon which the parties have agreed and the 20 stipulated sanction to be imposed. Ms. Clifford stipulates that there is sufficient evidence in the 21 Commission's files and records to support the findings of fact, conclusions of law, and order set 22 forth below. 23 By signing below, Ms. Clifford acknowledges, understands, stipulates, and agrees to the 24 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 25 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 26 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 27 Order of Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public .5 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and Page 1 STIPULATION OF FACTS AND ORDER PROBATION-CLIFFORD, LORI ‘ Final Order is contingent upon and subject to approval and adoption by the Commission. If the 2 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 3 Clifford nor the Commission are bound by the terms herein; (iv) she has fully read this 4 Stipulation and Final Order, and understands it completely; (v) she voluntarily, Without any force 5 or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the 6 Stipulated Final Order below; (vi) She states that no promises or representation has been made 7 to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an 8 attorney regarding this Stipulation and Final Order and has been fully advised with regard to her 9 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 1O Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 11 STIPULATION OF FACTS 12 1. Ms. Clifford currently holds an Initial School Counselor License valid September 4, 2003, through February 18, 2007, with a School Counselor Endorsement. it 2. Ms. Clifford is employed by Beaverton School District. f5 3. Ms. Clifford violated a condition of her probation with the Commission by consuming 16 alcohol. 17 4. On March 29, 2006, Ms. Clifford voluntarily sought an evaluation for alcohol addiction 18 and treatment with Kaiser Permanente NW. Ms. Clifford has signed an authorization for Kaiser 19 Permanente to release to the Commission regarding her progress and recovery. 20 5. On June 1, 2006, Ms. Clifford completed an Outpatient Treatment Program with 21 Kaiser Permanente NW. Ms. Clifford is currently participating in an aftercare program 22 supervised by Kaiser Permanente NW. 23 IT IS O STIPULATED AND AGREED T0: 24 J t M ’._ ‘.1 MM 25 )Wy/ I Date G (4 cal/ig/{ICfl ‘3'4 1 414‘ M ictoria _ - b Iain, Executive Director Date Page 2 STIPULATION OF FACTS AND ORDER PROBATION-CLIFFORD, LORI ‘ CONCLUSION OF LAW 2 Lori Ann Clifford failed to comply with a specific condition of the four year Probation 3 (effective September 4, 2003 through September 4, 2007) by consuming alcohol in violation of 4 OAR 584-020-0040(4)(k) which constitutes Gross Neglect of Duty. The Commission has 5 authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR 6 Chapter 584. 7 FINAL ORDER 8 The Commission adopts and incorporates herein the above findings of fact and 9 conclusion of law, and based hereon, hereby extends Ms. Clifford’s Probation for a period of two 1O (2) additional years, to September 4, 2009, subject to the following terms and conditions: 11 1. Ms. Ciifford shail, at her own initiative and expense, continue to obtain treatment for 12 her alcohol dependency as recommended by her alcohol treatment provider and abstain from 3 the consumption of alcohol; qt 2. During the period of her probation, Ms. Clifford shall submit to the Executive Director 15 of the Commission reports of her compliance with the aftercare treatment plan. Ms. Clifford 16 shall provide these reports every six (6) months during her probation, on or before September 4, 17 2006; March 4, 2007; September 4, 2007; March 4, 2008, September 4, 2008, March 4, 2009; 18 and September 4, 2009; 19 I 3. Ms. Clifford shall conduct herself as a law-abiding citizen; 20 4. Ms. Clifford shaii report in writing within ten days to the Executive Director of the 21 Commission any arrest or citation for any feiony, misdemeanor, major traffic violation or 22 violation of criminal probation; and 23 5. Ms. Ciifford shalt comply with the Standards for Competent and Ethical Performance 24 of Oregon Educators under Oregon Administrative Rules, Chapter 584, Division 020.
