ALLISON GILLIGAN ) OF RIGHT TO APPLY i g On April 3, 2013, the Commission referred E. Allison Gilligan (Gilligan) to 8 investigation for violation of professional practices standards. 9 After review of the matters alleged, Gilligan and the Commission agree that their 1O respective interests, together with the public interest, are best served by a stipulation to 1 1 certain facts, and revocation of her right to apply for licensure. 12 By signing below, Gilligan acknowledges, understands, stipulates, and agrees to 13 the following: (i) she has been fully advised of her rights t0 notice and a hearing to 14 contest the findings of fact, conclusions of law, and order set forth below, and fully and 15 finally waives all such rights and any rights to appeal or otherwise challenge this 16 Stipulation of Facts and Final Order of Revocation of Right to Apply (Stipulation and 17 Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 18 the public upon request by the Commission; (iii) this Stipulation and Final Order is 1 9 contingent upon and subject to approval and adoption by the Commission. If the 20 Commission does not approve and adopt this Stipulation and Final Order, then neither 21 Gilligan nor the Commission are bound by the terms herein; (iv) she has fully read this 22 Stipulation and Final Order, and understands it completely; (v) she voluntarily, without 23 any force or duress, enters into this Stipulation and Final Order and consents to issuance 24 and entry of the Stipulated Final Order below; (vi) she states that no promise or 25 representation has been made to induce her to sign this Stipulation and Final Order; and 26 (vii) she has consulted with an attorney regarding this Stipulation and Final Order and 27 has been fully advised with regard to her rights thereto, or waives any and all rights t0 28 consult with an attorney prior to entering into this Stipulation and Final Order and 29 issuance and entry of the Stipulated Final Order below. 30 STIPULATION 0F FACTS 31 1. E. Allison Gilligan has been registered by the Commission since June 13, 2002. Gilligan 32 held a Charter School Registry with an endorsement in Educational Media (PP'12); 33 issued June 13, 2002, which expired on August 12, 2005. During all relevant times, 34 Gilligan was employed by the Armadillo Technical Institute Charter School of the 35 Phoenix-Talent School District. On November 29, 2011, Gilligan filed a C-1 application to reinstate her charter school 2 registration. Gilligan failed to respond t0 two notices from TSPC that her application ‘ 3 was incomplete sent on February 24, 2011 and April 25, 2011. i 4 3. Eighteen months later on October 1, 2012 TSPC received Gilligan’s second C-1 i 5 application for reinstatement of her Oregon Charter School Registry. TSPC sent notices 6 that Gilligan’s application was incomplete on November 15, 2012 and November 19, 7 2012. Specifically, Gilligan had failed to submit the fee to process the application. The 8 fee was finally submitted on February 1, 2013. On February 3, 2012 Gilligan's 9 application was referred to investigations for review. Gilligan’s Professional Educational 1O Experience Report (PEER) form received 0n October 1, 2012, indicated she had been . 1 1 consistently employed as an educator from 2005 until the time of her application in 12 2012. The Commission’s investigation determined that Gilligan worked as an educator 13 from the time 0f the expiration of her charter school registration, August 2005 until 14 August 2012 without a license or registration for a a period of approximately seven (7) 1 5 years. 16 Gilligan denies any intent to work without proper charter school registration and offers 17 several explanations as to why she was not properly registered. These include 18 communications breakdowns between Gilligan and her charter school and the chartering 19 school district and having multiple TSPC accounts under different variations of her 20 name. Gilligan understands that the responsibility for proper registration falls upon the 21 educator regardless of an individual’s circumstances or difficulties and if for any reason 22 becomes unregistered or unlicensed, must be removed from the classroom until the 23 proper registration has been obtained. 24 IT IS SO STIPULATED: 25 é’ 26 ~ fling ZZZ; 4 212013011 27 E. Allison Gilligan was employed as an educator while not properly licensed for a 35 period of seven (7) years.
