Q BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 DANIEL COLIN WILLEY ) LICENSE REVOCATION 7 On August 10, 2005, the Teacher Standards and Practices Commission (Commission) 8 issued a Notice of Opportunity for Hearing t0 Daniel Colin Willey (Willey) in which the 9 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S. 10 First Class Mail and U.S. Certified Mail Receipt 7005 0390 0005 5794 8378 to the address 11 obtained by the Commission. On August 12, 2005, the U.S. Certified Mail was signed and 12 returned to the Commission. The Notice of Opportunity of Hearing, dated August 10, 2005, and 13 signed by Victoria Chamberlain, Executive Director, stated: l4 “You, Daniel Colin Willey, are entitled to a hearing on the proposed action of the 15 Commission. If you want a hearing, you must file a written request for a hearing 16 with the Commission within 21 days of the date of this notice. Attached to this notice is a copy of the procedures, right of representation and other rights of parties relating to the conduct of a hearing as required under ORS 183.413(2)." 19 20 Mr. Willey did not request a hearing. The Commission, therefore, finds Mr. Willey 21 to be in default and enters the following findings of tact, conclusions oi law and order, 22 based on the files and records of the Commission concerning this matter. 23 FINDINGS OF FACT 24 1. Mr. Willey holds an Initial Teaching License issued March 17, 2004, valid through 25 March 9, 2007, with a Basic Mathematics endorsement. Mr. Willey is not currently employed as 26 a licensed educator. 27 2. On May 7, 2004, the Commission adopted a Stipulation of Facts and Order of 28 Probation. The Commission imposed a three-year probation which required bi-annual reports of 29 compliance with an alcohol treatment plan. On or before September 1, 2004, and March 1, 2005, Mr. Willey failed to make 2 reports to the Executive Director of his compliance with his treatment plan pursuant to the 3 Stipulation of Facts and Order of Probation adopted by the Commission on May 7, 2004. 4 4. Mr. Willey has refused to respond to the Commission’s repeated requests for 5 additional information and compliance in this matter. 6 CONCLUSIONS OF LAW 7 Daniel Colin Willey violated terms and conditions of an Order of Probation adopted by 8 the Commission on May 7, 2004, in violation of OAR 584-020-0040(4)(k). This behavior 9 constitutes Gross Neglect of Duty.
