1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON RECEIVED 3 In the Matter of the ) STIPULATION OF FACTS JUN 2 3. 2008 4 Teaching License of ) AND FINAL ORDER 5 HEATHER LYN BICKEL ) OF REPRIMAND Teficher Standards 8, Practices Commission 6 On or about March 28, 2008, the Teacher Standards and Practices Commission 7 (Commission) received a report from the McMinnville School District that Heather Lyn Bickel 8 (Bickel) served without proper licensure during the fall semester of 2007. Ms. Bickel allowed 9 her licensure to lapse in September 2007. 10 Ms. Bickel fully cooperated with the Commission's investigation. After review of the 11 matters alleged, Ms. Bickel and the Executive Director agree that their respective interests, 12 together with the public interest, are best served by a stipulation to certain facts and a public 1 3 reprimand. 14 This document sets forth the facts upon which the parties have agreed and the 15 stipulated sanction to be imposed. Ms. Bickel stipulates that there is sufficient evidence in the 16 Commission’s files and records to support the findings of fact, conclusions of law, and order set 17 forth below. 18 By signing below, Ms. Bickel acknowledges, understands, stipulates, and agrees to the 19 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 20 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 21 such rights and any rights to appeal or othenivise challenge this Stipulation of Facts and Final 22 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 23 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 24 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 25 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 26 Bickel nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation 27 and Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 28 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — BICKEL, HEATHER LYN. 1 Final Order below; (vi) she states that no promises or representation has been made to induce 2 her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 3 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 4 thereto, or waives any and all rights to consult with an attorney prior to entering into this 5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 6 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. 7 Ms. Bickel stipulates that there are sufficient facts contained in the Commission 's files and 8 records to support the findings of fact and conclusions of law set forth below. In entering into 9 this stipulation, Ms. Bickel waives the right to a hearing to contest the findings of fact, conclusion 10 of law and order set forth below. 11 STIPULATION OF FACTS 12 1. Ms. Bickel held a Transitional Teaching License with endorsements in Multiple 13 Subjects Self-Contained (ECE and ELE) and Reading (ECE/ELE; MLIHS) from 14 September 3, 2004 through September 3, 2007. 15 2. Ms. Bickel submitted timely application for the Initial I Teaching license, triggering the 16 120 day extension to the expiration of her license but did not submit any passing 17 scores for the Basic Skills test requirement, the Multiple Subjects Examination for the 18 Multiple Subjects endorsement or the Praxis Reading test for the Reading 19 endorsement which she could have completed during the three years she held the 2O Transitional Teaching License. 21 3. Ms. Bickel did not notify her district that she had not completed the work she needed 22 to qualify for the next stage license. 23 4. Ms. Bickel taught from January 8, 2008 to March 26, 2008 without a valid teaching 24 license. ‘ 25 5. To date, Ms. Bickel has only submitted passing scores on the MSE and currently ‘ 26 holds an emergency teaching license valid from March 26, 2008 to June 20, 2008. This misconduct constitutes Gross Neglect of Duty. 4 The Commission's authority to impose discipline in this matter is based upon ORS 342.175 and 5 OAR 584-020-0030(3). 6 IT IS SO TIP TED: / .
