1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Mat'ter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 RONALD MAX LONG ) FINAL ORDER OF REPRIMAND 6 On January 22, 2007, the Teacher Standards and Practices Commission (Commission) 7 received a report from Steve Swisher, Superintendent, Crook County School District, indicating that 8 Ronald Max Long (Long) failed to maintain an appropriate professional student-teacher relationship 9 and failed to use skill in communicating with students. 10 Mr. Long fully cooperated with the Commission's investigation. After review of the matters 11 alleged, Mr. Long and the Commission agree that their respective interests, together with the public 12 interest, are best served by a stipulation to certain facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the stipulated 14 sanction to be imposed. Mr. Long stipulates that there is sufficient evidence in the Commission's files ' and records to support the findings of fact, conclusions of law, and order set forth below. 16 By signing below, Mr. Long acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 19 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand ' 20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 21 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon 22 and subject to approval and adoption by the Commission. If the Commission does not approve and 23 adopt this Stipulation and Final Order, then neither Mr. Long nor the Commission are bound by the , 24 terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 25 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to 26 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or ' representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he has _ 28 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with l Page 1 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - LONG 1 regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering . into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 3 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Mr. 4 Long stipulates that there are sufficient facts contained in the Commission‘s files and records to 5 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Mr. 6 Long waives the right to a hearing to contest the findings of fact, conclusion of law and order set forth 7 below. 8 STIPULATION OF FACTS 9 1. The Commission has licensed Mr. Long since Jane 22, 2005. Mr. Long cun'ently holds a 10 Restricted Transitional Teaching License valid September 6, 2006, through June 22, 2008, with a 1 1 Basic Mathematics endorsement. 12 2. Mr. Long served as a 7m grade mathematics teacher for Crook County Schools. Mr. Long 13 resigned from his position with the District in lieu of an intemal investigation. ' 3. Mr. Long expressed professionally inappropriate interest in a students personal life when 15 he asked her a series of questions about her interests and then prepared a scrapbook of her favorite 16 things. 17 4. It is alleged that Mr. Long made inappropriate remarks to students and one staff member. 18 Specifically that he used vulgar language towards student athletes and mimicked urinating before a 19 classroom on another occasion. 20 5. Ronald Max Long's failure to maintain an appropriate professional student-teacher relationship 3 by not demonstrating or expressing professionally inappropriate interest in a students personal life is 4 a violation of OAR 584-020-0035(1)(c)(A), a deviation from professional standards of ethics as that 5 rule incorporates OAR 584-020-0010(5) use of professional judgment. Mr. Long's failure to use skill 6 in communicating to students when he use of vulgar language in the classroom is a violation of OAR I 7 584-020-0030(2)(b). The Commission has the authority to impose discipline in this matter under ORS 8 342.120 through 342.430 and OAR Chapter 584. 9 FINAL ORDER 10 The Commission adopts and incorporates herein the above finding of facts, conclusions of ' 11 law, and based thereon, imposes a Public Reprimand on Ronald Max Long.
