5 TIMOTHY NICHOLAS TAYLOR ) ORDER OF REVOCATION

6 On or about August 6, 2007, the Teacher Standards and Practices Commission

7 (Commission) received a report from Debbie Gillespie, Superintendent, Dayville School District,

8 indicating that Timothy Nicholas Taylor (Taylor) was arrested based on an allegation that he

9 touched a 15 year old female student inappropriately, but the charges were civilly compromised I
1O and the charges were dismissed.
11 Taylor fully cooperated with the Commission’s investigation, After review of the matters
12 alleged, Mr. Taylor and the Commission agree that their respective interests, together with the
13 public interest, are best served by a stipulation to certain facts and a surrender of his teaching
14 license pursuant to OAR 584-020-0027.
15 This document sets forth the facts upon which the parties have agreed and the
16 stipulated sanction to be imposed‘ Mr. Taylor stipulates that there is sufficient evidence in the
17 Commission’s files and records to support the findings of fact, conclusions of law, and order set
18 forth below.
19 By signing below, Mr. Taylor acknowledges, understands, stipulates, and agrees to the
20 following: (i) he has been fully advised of his rights to notice and a hearing to contest the ,
21 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
22 such rights and any rights to appeal or othenivise challenge this Stipulation of Facts, Surrender
23 and Final Order of Revocation (Stipulation and Final Order); (ii) this Stipulation and Final Order
24 is a public document and disclosed to the public upon request by the Commission; (iii) this
25 Stipulation and Final Order Is contingent upon and subject to approval and adoption by the
26 Commission, If the Commission does not approve and adopt this Stipulation and Final Order,
27 then neither Mr. Taylor nor the Commission are bound by the terms herein; (iv) he has fully read

1 this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without any
2 force or duress, enters into this Stipulation and Final Order and consents to issuance and entry
3 of the Stipulated Final Order below; (vi) he states that no promises or representation has been
4 made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an
5 attorney regarding this Stipulation and Final Order and has been fully advised with regard to his
6 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this
7 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.
8 STIPULATION OF FACTS
9 1. The Commission has licensed Timothy Nicholas Taylor since September 7, 2006.
10 Mr. Taylor currently holds an Initial Teaching License valid August 24, 2007, through September
11 7, 2009, with an Advanced Mathematics Endorsement. Mr. Taylor formerly taught math in North
12 Carolina.
13 2. A police investigation determined that on December 22, 2006, on a school bus during
14 an outing, Taylor inappropriately touched a female student in a sexual manner.
15 3. A police investigation determined that on January 2, 2007 during a family outing,
16 Taylor again inappropriately touched the same female student in a sexual manner.
17 4. Mr. Taylor denies the allegations of inappropriate touching.
18 5. On July 27, 2007 Taylor resigned his teaching position with the Dayville School

1 CONCLUSIONS OF LAW

2 Timothy Nicholas Taylor touched a female student inappropriately. This conduct

3 constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(f) and OAR 584-020-

4 OO40(4)(0) as it incorporates OAR 584-020-0035(1)(c)(D) and Gross Unfitness in violation of

5 OAR 584-020-0040(5)(e). The Commission has authority to impose discipline in this matter

6 under ORS 342.120 through 342.430 and OAR Chapter 584.

7 ORDER

8 The Commission hereby adopts and incorporates herein the above findings of fact and I

9 accepts the surrender of Timothy Nicholas Taylor's Initial Teaching License and hereby revokes ‘
1O said license.
